S21 notice/Rent arrears/repossession order?

Hello, I have a question: My tenant is in rent arrears by 6 months and those arrears now stand at £9,600. I have served the tenant a S21 notice followed by a repossession order.

The council pays the tenant £1,875/month towards the rent. The council is also aware that a S21 has been served.

Is it fair for the council to continue to hand over £1,850/ month towards the rent when the tenant is holding back that money?

Just to clarify, UC can reclaim the money if there appears to be any issue with the tenants UC claim.

I contacted DWP and was told they had no record of my tenant receiving housing benefit. When I finally evicted him [after 16 months] and managed to open his postbox, I found letters from DWP confirming he had been. So, he had been paid all his SEIS grants, continued working throughout lockdowns, was being paid housing benefit, and wasn't paying rent. Can't trust DWP to work with landlords.

I must admit I am really surprised that DWP would actually 'talk to you' without your tenants express authority [which I guess they would not have given in any event]. To do so without this authority would have clearly breached GDPR.

the DWP don't issue HB. Presume you meant the rent element of UC?

Really surprised, as they were breaching GDPR, assuming they did not have your tenants authority to do so.

Something not right here. Rent is paid by UC. Or HB if of pensionable age, or if the area is not mandatory UC yet. Certainly NOT DWP.

Just to clarify. UC is administered centrally, and is quite quick to deal with. HB is administered by Local Authorities, and like most things to do with LA's can be painfully slow.
