Who is responsible for flat damage?

Hello everyone, A tenant went on holiday for a month, came back and her flat had been robbed.

Thieves had damaged the windows and wooden flooring, made a mess elsewhere so a deep clean will be needed.

She claims it’s my responsibility to make all good again and organise a clean and fix the windows.

Is that right??

Look at Contract between you and T. Suspect unlikely T is liable?
Look at Insurance for your own escape and remedy.

That's why you have landlord insurance for that one time when your flat is broken into. Think about car insurance, you never have a crash, but you have it anyway (although it is a legal requirement). Did your tenant tell you she was going away for over a month? My ground floor flats all have timers with radio and lights that come on a various times of the day and night so people think someone is in. Its a simple and cheap option. You don't have insurance, so yet the cost is yours

A flat will be insured by the freeholder, get in touch with them. It won't take long - since you have to do the repairs anyway (yes it is your responsibility, why would you think it is the tenant's if you are an experienced landlord?) most insurers will pay out on invoices and it doesn't take long. You have a crime number? Sometimes freeholders can be awkward especially if flat-owner owned but if so apply direct to the insurance company
