West Bromwich Building Society Tracker Margins Legal Action

Are you affected by the West Brom Tracker Rate Hike?

If your mortgage account number begins with the number 8 you are highly likely to be one of the unlucky 41% of the mortgage customers of the West Bromwich building Society with a West Bromwich Mortgage Company account affected by the 1.9% increase in your tracker margin rate. However, if you arranged your mortgage directly with West Bromwich Building Society (i.e. not via a broker) or before 2006 the chances are that your account number will begin with the number 9 and you are not affected – YET!!! West Brom will give no assurances that mortgages with account numbers beginning with the number 9 will not be affected at some point in the future.

The reasons we started this campaign are very simple:-

1) We believe the actions of West Brom are immoral

2) We believe the actions of West Brom are unlawful, i.e. they have no legal grounds to increase their tracker rate margins

3) We have no wish to subsidise other areas of the West Bromwich Building Society business model

4) We are fearful of other lenders following suit if West Brom are allowed to get away with this

Mark Smith (Barrister-At-Law) said …

“Representative actions, where one person starts a case representing many others, who all want the answer to a legal question from a court such as ‘is this contract enforceable against me?’ but are not seeking damages. All those who sign up to the action will get the benefit of the win, but they do not have to start their own cases, as they are ‘represented’ by the lead claimant.

The only people who will definitely benefit from success in the case are those who have signed up. There will be no free rides. Any others will have to fight their own corners individually, either alone or with legal help (which will inevitably cost significantly more than the group case).”

Having said that, I can only see my comment when logged into the website. It doesn't show when logged out. I guess it needs to be approved.

Having received the Property118 mailshot from Neil Patterson the other day I thought that it would be a good idea to ask local letting agents to put a mailshot, informing landlords of the class action, in with their monthly rental statements to landlords.
I have run this idea by Mark and he has suggested that I ask Alex Bell if he would be good enough to draft a template that we could all print off and pass to our local letting agents. So if Alex would be kind enough to do this we would all be very grateful. The local agents that I have spoken to are keen to help and we should remember that there are still a lot of West Brom borrowers out there who are unaware of the class action.

Can anyone see their comments on the link to West Broms lovely new offices?

I left two that seem to have gone so I have gone in again and put a link back to here . If they keep removing the link I will just keep adding it until they remove me. Why would a newspaper remove simply links ?

I cant see Marks comment yet or Mike L . Have they got something against us ?

My mistake, I told Greg his name was Alex Bell.

I've since found his email address and invited him to comment.

I really do think this is a great idea as many of us employ accountants and letting agents who send regular statements to landlords so it should be easy for them to slip in a leaflet at the same time.

Ideally we need an A4 PDF which can be hosted and linked to on this website so that people can print it off as required 🙂

If anybody has the software and experience to knock something up quickly then it could be doing the campaign a big favour. If we end up with a few options for people to choose from there's nothing wrong with that. We can host and link to them all 🙂

I can see a couple which may have come from members here but I can't see my own unless I'm logged in. I suspect it's awaiting moderation.

My business partner has tried to contact the journalist who wrote the article but she seems to have gone into hiding. Perhaps she's investigating a story based on all the comments she's afraid to approve? We can but hope 😉

LEGAL ACTION UPDATE:

I am updating the forum today as I am out of the office tomorrow.

We now have instructions in relation to 181 loans. We have heard from WBBS's solicitors in response to our initial letter to WBBS. We asked them to clarify:-

1 Their reasons behind the increase (resulting from market conditions) taking into account that they are currently offering new mortgages at rates lower than the proposed increased rates.

2 Why are they targeting borrowers who currently own 3 or more properties

3 The contractual basis for the proposed increases

4 Why their website definition of Tracker Mortgages is not misleading

Their solicitors declined to answer any of our questions.

We are currently awaiting our Counsel's opinion on the issues. We do not expect to receive this back for some time. When we do get it back we will be deciding on the best way forward. We will also at that time provide everyone who has instructed us with a partially completed form and covering letter to send to the Financial Ombudsman Service to lodge a complaint. The form will include the suggested arguments put forward by Counsel.

I have noted a number of comments on the forum this week about cancelling direct debits and setting up a standing order or disputing direct debits. Whilst we cannot advocate this practice, and we must warn you that this could have a detrimental effect on your credit rating - which may be difficult to restore, this would bring things to a head quicker. The decision on what you do in this regard, is entirely yours but we must stress that it is not without risks.

I have also noted some heated debate about prospects of settlement etc. It is much too early to speculate on how this will pan out. All I can say is that I will do whatever my instructing clients ask me to do.

Please keep up all the excellent work in raising awareness of our case, including writing to MPs and other official bodies.

I will update the forum again at the end of next week.
