West Bromwich Building Society Tracker Margins Legal Action

Are you affected by the West Brom Tracker Rate Hike?

If your mortgage account number begins with the number 8 you are highly likely to be one of the unlucky 41% of the mortgage customers of the West Bromwich building Society with a West Bromwich Mortgage Company account affected by the 1.9% increase in your tracker margin rate. However, if you arranged your mortgage directly with West Bromwich Building Society (i.e. not via a broker) or before 2006 the chances are that your account number will begin with the number 9 and you are not affected – YET!!! West Brom will give no assurances that mortgages with account numbers beginning with the number 9 will not be affected at some point in the future.

Tracker Rate Class Actions Updates

The reasons we started this campaign are very simple:-

1) We believe the actions of West Brom are immoral

2) We believe the actions of West Brom are unlawful, i.e. they have no legal grounds to increase their tracker rate margins

3) We have no wish to subsidise other areas of the West Bromwich Building Society business model

4) We are fearful of other lenders following suit if West Brom are allowed to get away with this

Mark Smith (Barrister-At-Law) said …

“Representative actions, where one person starts a case representing many others, who all want the answer to a legal question from a court such as ‘is this contract enforceable against me?’ but are not seeking damages. All those who sign up to the action will get the benefit of the win, but they do not have to start their own cases, as they are ‘represented’ by the lead claimant.

The only people who will definitely benefit from success in the case are those who have signed up. There will be no free rides. Any others will have to fight their own corners individually, either alone or with legal help (which will inevitably cost significantly more than the group case).”

Goodafternoon everyone. I am considering joinning the class action.
Could you please explain;
1) What I would need to do if i have a West Brom Mortgage?
2) How much it will cost per mortgage?
3) What paperwork i need to photocopy and submit for each mortgage and to whom i send it to?
4) Will there be more costs along the way?
5) What will happen if there is a surplus of funds?
6) Is the 100k quoted the actual final figure needed to take this to court/ appeal etc?
7) Is there a risk of members who join the class action being held financially liable for any costs of either party if the action was to fail?
8) What sort of time scales do you envisage this process taking?

At present I have had my final decision in writing from West Brom and have contacted the Ombudsmen who has opened a case and has sent me their paperwork.
I am a memeber of a regional association of landlords and I believe there are a number of members who are considering joinning the class action.

Mark, I was relieved to read your post as I had been starting to regret recommending the site to members of the local Private Sector Housing forum last week. It has been my view throughout that the objective should be to end up with a definitive ruling on the legality of the WBBS actions, unless of course they get cold feet and reverse their decision.
5 weeks may seem a long time when you are waiting for something to happen but to achieve the progress that has already been made in what is actually quite a short period is a remarkable achievement.

I had expected some people to object to my stance but it would appear that either they now understand my position and agree or they are too ashamed to admit they don't agree in view of the supportive comments made by their peers. I've just been catching up on comments after a few days away. My quick thoughts -

Putting my web marketing hat on: Tony's questions have given a fantastic insight in to the thought process that will be going through the minds of the new visitors that the SEO activities are generating. In web speak, it's all about "conversion". At the moment with many different points of entry to the site it not easy for newcomers to find the information they need. The info is there at http://www.property118.com/tracker-rate-class-actions-update/44117/ but its not the landing page most visitors will be arriving at so it's possible that the campaign for sign up is stumbling at this last hurdle.

Suggestions if you get chance
SEO, meta title, description, image alts not mentioning West Bromwich on "tracker-rate-class-actions-update".
Funnel from all WB entry points to the update page (e.g. image based "worst con" advert style link on home page and WB landing pages)
FAQ section on the page, Tony's are pretty much perfect. Call to actions could be stronger. Plus any reasons, objections to joining class action? - Please ask (link to these comments)

I appreciate the feedback.

I have transferred the Updates page to become the lead post in this page. The SEO you have suggested is done. This forum page will now become the landing page as well as the discussion forum as it has the best SEO. I have also changed the URL extension on this page and put 301 re-directs on the former Update page and other pages which are no longer necessary due to be out-dated.

The gravity forms we've used for data-capture and processing also have auto-responders which will now redirect people back here as well as sending them emails specific to their circumstances. You will need to use an alternative email address to test this as we have blocked duplicate entries to deter spammers.

Please take another look at this page and associated functionality. You know how it can be, it's so much easier to provide constructive feedback when you're outside of the woods.
