West Bromwich Building Society Tracker Margins Legal Action

Are you affected by the West Brom Tracker Rate Hike?

If your mortgage account number begins with the number 8 you are highly likely to be one of the unlucky 41% of the mortgage customers of the West Bromwich building Society with a West Bromwich Mortgage Company account affected by the 1.9% increase in your tracker margin rate. However, if you arranged your mortgage directly with West Bromwich Building Society (i.e. not via a broker) or before 2006 the chances are that your account number will begin with the number 9 and you are not affected – YET!!! West Brom will give no assurances that mortgages with account numbers beginning with the number 9 will not be affected at some point in the future.

Tracker Rate Class Actions Updates

The reasons we started this campaign are very simple:-

1) We believe the actions of West Brom are immoral

2) We believe the actions of West Brom are unlawful, i.e. they have no legal grounds to increase their tracker rate margins

3) We have no wish to subsidise other areas of the West Bromwich Building Society business model

4) We are fearful of other lenders following suit if West Brom are allowed to get away with this

Mark Smith (Barrister-At-Law) said …

“Representative actions, where one person starts a case representing many others, who all want the answer to a legal question from a court such as ‘is this contract enforceable against me?’ but are not seeking damages. All those who sign up to the action will get the benefit of the win, but they do not have to start their own cases, as they are ‘represented’ by the lead claimant.

The only people who will definitely benefit from success in the case are those who have signed up. There will be no free rides. Any others will have to fight their own corners individually, either alone or with legal help (which will inevitably cost significantly more than the group case).”

I was planning to write a letter of disappointment to all the WBBS board members, and I know that earlier in this thread their names were all published.

four pence worth as I have probably run out of tuppence worth by now.

I think the argument about whether we should be selfish (yes I mean selfish) by deneighing other people the benefit of our experiences (wish I could spell) i.e. only allowing names to benefit from any court action, would set a precedent and only allow the oppressors to continue oppressing. ( I use the word oppress to suggest that IF those who sacrificed themselves in any war had not done so we would all probably speak German by edict!) I know this is an extreme example but I for 1 (and I have 6 mortgages so my bill go up hugely) sent my money to help ALL.

Unfortunately that means I will be assisting those who perhaps may not deserve it but that is altruism a word too few of us recognize.

To ALL

Carry on the good work ,this arguement is not about infighting and greed about who should or should not be let into our little clique but, about not letting the WBBS and OTHERS get away with blatent profiteering lets fight the WBBS (and others)

Again I apologize for my dreadful spelling but its quicker to write my thoughts than spend valuable time spelling it correctly.

I couldn't agree more - or have put it better. There's a maxim isn't there which goes: 'divide and conquer' which I believe would apply here - we need to STAND TOGETHER against this financial bullying and not be tempted into stooping to internal bickering and sniping imho

QUESTION

I've had a WBBS borrower email me over the weekend to say that he has 4 BTL mortgages with them and three elsewhere. He arranged the mortgages direct through WBBS.

He has not been notified on any increases.

He has not moved house for 10 years and he receives regular correspondence from WBBS.

For obvious reasons he doesn't want to reveal his identity here.

My question is this ...... did anybody else here arrange their mortgages directly with WBBS?

Given the circumstances, one has to wonder whether WBBS have decided not to target direct customers and only loans arranged via intermediaries. If that is the case it's potentially another very powerful argument for us.

I have followed the correspondence of the last week or so from abroad with a bit of a sense of foreboding. Although I am not directly involved as I do not have any wbbs mortgages I have supported the campaign from the beginning and I believe I was one of the first people to send money to Mark to help. I was happy to do that and would do so again if needed. I find it quite offensive to be told that only the "inner circle" would benefit from any legal decisions or offers from wbbs with others not even knowing if a "deal" was done.

Over the past weeks I have watched what was a brilliantly organised campaign become what Ian has described and I have quite frankly despaired.

Ian and Denise have hit the nail right on the head. The campaign will only succeed if everyone fights this together - irrespectively of whether people benefit who did not contribute and if the campaign is organised and professional. People like David Lawrenson bring gravitas to the campaign which is what you need if you are taking on an institution both in Law and in Public Opinion. All of those who are working to involve MPs and others are to be congratulated as well for that contribution but at the end of the day Mark and Justin must be able to rely on Counsel's Opinion as to the way forward and direct the campaign from there. Until we have that Opinion everyone should concentrate on getting as much dignified publicity for the cause as possible. I think that a short statement from Mark would be welcomed to the effect that everyone who has contributed to the campaign is part of it and that any Judgments/offers that result will be shared openly to stop others thinking they can get away with such things in the future.

BBC News Update

Having been away for the weekend I am just catching up and have watched the BBC Your Money Programme. I can't find it on iPlayer but there is an article on the BBC website >>> http://www.bbc.co.uk/news/business-24676086

I was very dissapointed that Property118 didn't get a mention in the programme but I think Michelle and Justin came across well and it was good to have Ray Boulger from Charcol's saying he was concerned that other lenders could follow suit and also confirming that West Brom are the 4th lender to do this. It was mentioned that BoI residential customers have seen a second increase in their tracker mortgage margins this months, the first was in June this year.

We haven't had a massive influx of new interest as I would have hoped and the number who have now completed the expression of interest form is 983.

I have not yet sent my cheque as I am still awaiting a reply to all of my questions from WBBS and the broker who I am assured was made aware of all of the clauses. Once have all of my replies I will forward all of the papers and payment.

I emailed this comment yesterday to Holly O'Sullivan at WBBS.

Surely option 5 does no apply since you claim to be altering the additional percentage. This was not expressed as interest but a premium of a specified amount .89%

Definition of 'Premium'

The total cost of an option!

In reading the terms and conditions section 5 does not state that the premium can be altered.
If you wished to amend this you should have specified that the premium could be altered in the terms and conditions booklet.
