West Bromwich Building Society Tracker Margins Legal Action

Are you affected by the West Brom Tracker Rate Hike?

If your mortgage account number begins with the number 8 you are highly likely to be one of the unlucky 41% of the mortgage customers of the West Bromwich building Society with a West Bromwich Mortgage Company account affected by the 1.9% increase in your tracker margin rate. However, if you arranged your mortgage directly with West Bromwich Building Society (i.e. not via a broker) or before 2006 the chances are that your account number will begin with the number 9 and you are not affected – YET!!! West Brom will give no assurances that mortgages with account numbers beginning with the number 9 will not be affected at some point in the future.

The reasons we started this campaign are very simple:-

1) We believe the actions of West Brom are immoral

2) We believe the actions of West Brom are unlawful, i.e. they have no legal grounds to increase their tracker rate margins

3) We have no wish to subsidise other areas of the West Bromwich Building Society business model

4) We are fearful of other lenders following suit if West Brom are allowed to get away with this

Mark Smith (Barrister-At-Law) said …

“Representative actions, where one person starts a case representing many others, who all want the answer to a legal question from a court such as ‘is this contract enforceable against me?’ but are not seeking damages. All those who sign up to the action will get the benefit of the win, but they do not have to start their own cases, as they are ‘represented’ by the lead claimant.

The only people who will definitely benefit from success in the case are those who have signed up. There will be no free rides. Any others will have to fight their own corners individually, either alone or with legal help (which will inevitably cost significantly more than the group case).”

When I signed up for BoI class action it took over 2 weeks to get a Emailed confirmation from Justins team so I wouldn't be to concerned as above he's working hard on more important issues.

LEGAL ACTION UPDATE:

I note there is growing concern on the forum that you have not received an acknowledgement from me for either your papers or your cheques. I apologise for not responding sooner but unfortunately my assistant who was to help me with this has been off for the past week. Today we started to work through the backlog and we have been through 18 sets of papers, with about 20 more to go, which we will get through tomorrow.

I felt it was more of a priority for us to get our letter to West Bromwich out last week and to draft our instructions to Counsel than to review everyone's paperwork. Now that we have done both, we are attending to everyone's paperwork.

Each day we are receiving between 5 and 10 new instructions which is fantastic as we are really building up a meaningful war-chest to enable us to start legal action against West Bromwich.

Anyone who has sent us papers and/or money will receive a response from us by the end of this week.

Mark - please accept my apologies for replying to the quick response box at the bottom of the e mail notification. I too am having a stressy day and trying to respond via my shiny new PC which doesnt seem to remember (yet I hope) stored details and passwords
so.... we too have now had letters back from both Cameron and Clegg - well their
Correspondence Officer - both addressed to my partner and not me (how rude
seeing I wrote the damn letters to them and which he simply co-signed) saying they have passed the letters to the Treasury. I too will be writing to them again to a) remind them we now live in the 21st Century where women are supposed to considered to be (at least) equal to men and b) asking for their opinion on this travesty as that is what I was asking for in the first place especially as I have already communicated myself (clever little woman that I am) with the Treasury seeking their views.

I've also had a reply from my MP, Pete Wishart, who has referred the matter to the Chancellor of the Exchequer no less!

I'm putting my faith in the law, and British justice. We were on a fixed rate with West Brom, when they wrote offering to transfer us back to our original tracker "with no floor, at BBR + 0.99% for the life of the mortgage". Had we stayed on the fixed rate mortgage we would have been immune to this 2% rate hike.

The only analogy I can think of is like being booked to sale the Atlantic on the Carpathia in 1912, when the captain of the Titanic persuades us to switch our booking to sail with him...

Had we stayed on the fixed rate mortgages we would have avoided this 2% rate hike.

My wife today received a reply from the Treasury. Don't hold your hopes out on these helping.

Apparently mortgage regulation was introduced to protect home owners. Buy to let landlords do not face the same risks. The government are committed to regulating only where it is plainly necessary to do so in order to avoid putting additional costs on businesses that would ultimately lead to higher costs for customers !!!!???? As a result buy to let landlords do not benefit from the same protection as mortgage borrowers.

I don't think Darren creamer has even read the letter my wife wrote.

He mentions it's not their responsibilty to control the commercial decisions of lenders .

No mention of the fact the lender had an agreed fixed rate over base. No link between higher costs for landlords therefore higher costs for tenants.

Not only as he not read the letter and agreements he can't even be consistent in his own letter. People like this get paid very well for a job they are not capable of doing.

To really rub salt in the wounds he goes onto to suggest we speak to the Money Advice Service !!!!!!

No disrespect to the individuals working this " Call Centre " but that's what it is. A call centre. Next week they will be selling Sky. !!

I have never called them but I can imagine they are there to help people budget . Set up a basic spread sheet. Advice on consolidating debt and who to go to . Does anyone think they would understand what to do when a large organisation cheats its customers ?

Safe to say Mr creamer will be getting a reply and a request to read the original letter sent , not to contradict himself and explain why he thinks referring us to the Money Advice Service call centre might have any relevance to this what so ever.

Mark. This letter may be of use to you when you are trying to get the NLA on board. I think it may be saying that what the NLA are looking to use as a defence is not going to work.
