West Bromwich Building Society Tracker Margins Legal Action

Are you affected by the West Brom Tracker Rate Hike?

If your mortgage account number begins with the number 8 you are highly likely to be one of the unlucky 41% of the mortgage customers of the West Bromwich building Society with a West Bromwich Mortgage Company account affected by the 1.9% increase in your tracker margin rate. However, if you arranged your mortgage directly with West Bromwich Building Society (i.e. not via a broker) or before 2006 the chances are that your account number will begin with the number 9 and you are not affected – YET!!! West Brom will give no assurances that mortgages with account numbers beginning with the number 9 will not be affected at some point in the future.

The reasons we started this campaign are very simple:-

1) We believe the actions of West Brom are immoral

2) We believe the actions of West Brom are unlawful, i.e. they have no legal grounds to increase their tracker rate margins

3) We have no wish to subsidise other areas of the West Bromwich Building Society business model

4) We are fearful of other lenders following suit if West Brom are allowed to get away with this

Mark Smith (Barrister-At-Law) said …

“Representative actions, where one person starts a case representing many others, who all want the answer to a legal question from a court such as ‘is this contract enforceable against me?’ but are not seeking damages. All those who sign up to the action will get the benefit of the win, but they do not have to start their own cases, as they are ‘represented’ by the lead claimant.

The only people who will definitely benefit from success in the case are those who have signed up. There will be no free rides. Any others will have to fight their own corners individually, either alone or with legal help (which will inevitably cost significantly more than the group case).”

Thanks Dean for reinforcing my observation that WBBS need to consider the financial impact on them of the £550 per pop FOC complaint cost as part of this nasty can of worms they have opened up, for reasons you have eloquently set out. Whether they will or not? Time will tell.

Just back from a short break and I am amazed at how much everyone is doing. Well done. If I may make a comment it would be to say that at the moment Property 118 comes across as a well organised, "professional" lobby group of landlords and any stunts might damage that impression. My view is that it would be far better if we knew when the next AGM of West Brom would be and we used that to hold a sort of "alternative" AGM either outside or in the Hall if we could get in, sit as a block and then make our point. If one of the people used to public speaking who is working with Justin would voice our complaints so much the better. A bit of advance warning to journalists on financial pages should ensure a bit of publicity and if we managed to get questions into the room these are likely to be reported and I believe must be included in the Minutes. As well as getting publicity this is likely to make the non executive directors sit up and listen.

So the rule of thumb would be put in individual complaints to Fos if you ave more than one b2 l mortgage

I would send in your complaints separate and leave days apart before you send the other one in, the more we can cost the WBBS the better.

Spot on. Justin will be providing a template complaint to FOS letter soon I think so doing it for each mortgage is a doddle. Don't think it is necessary to leave a big gap between complaints but using the same envelope for two or more might be tearing the a...e!!
I'm lucky having only one mortgage. Trouble is it is a whopper.

Hi Mark,
I just stumbled across your forum on Friday evening as I was browsing to find out any information on the above. I have 2 BTL trackers with WBMC and I have received notice of increase for both of them. I have already complained to WBMC to which I probably received their stock answer, and then submitted the complaint to the FOS.
I have today sent copies of both my mortgages and complaint letters etc to Justin Selig as per your automated email together with a cheque for £480.
I’m not sure how many people have signed up yet, but I can’t understand why almost all who are affected haven’t as it may prove to be the best money they’ve ever spent. It may be the case a lot of people are unaware of your efforts at the moment and hopefully as it gathers momentum and publicity will have an influx of participants.
I spent a few hours Friday night reading through a few postings and there certainly is passion to see this one through and I think you and others are doing a fantastic job of it.
I have made a few of my land lord friends aware of your forum as I know they have the same products, as we use the same FA.
Keep up the good work, I can’t see how WBMC can get away with this one if we all see it through.

There is a good chance - and I am sincerely hoping that that is the case - that a great majority of people affected have written to the Ombudsman directly and are now waiting for a response before joining this campaign. Although a bit protracted but nevertheless useful in bringing to fore the scale of this to the authorities. I however believe that it is only through prospect of going to the court that WB are going to withdraw their opportunistic action as they have quite a lot to loose...

Hi Mark,

It appears that Royal Mail have lost my information I sent to Justin on 10th October but they cant tell me for certain till 30th October! Two points from this please can you advise everyone NOT to sent it on their "Signed For Service" as it takes 20 days before they will do anything and secondly do you have a cut off date in mind for Justin (if so and it's before I get more info from the Post Office can I BACS the £240 direct to him and resend my details once they confirm they are lost?).
