West Bromwich Building Society Tracker Margins Legal Action

Are you affected by the West Brom Tracker Rate Hike?

If your mortgage account number begins with the number 8 you are highly likely to be one of the unlucky 41% of the mortgage customers of the West Bromwich building Society with a West Bromwich Mortgage Company account affected by the 1.9% increase in your tracker margin rate. However, if you arranged your mortgage directly with West Bromwich Building Society (i.e. not via a broker) or before 2006 the chances are that your account number will begin with the number 9 and you are not affected – YET!!! West Brom will give no assurances that mortgages with account numbers beginning with the number 9 will not be affected at some point in the future.

Tracker Rate Class Actions Updates

The reasons we started this campaign are very simple:-

1) We believe the actions of West Brom are immoral

2) We believe the actions of West Brom are unlawful, i.e. they have no legal grounds to increase their tracker rate margins

3) We have no wish to subsidise other areas of the West Bromwich Building Society business model

4) We are fearful of other lenders following suit if West Brom are allowed to get away with this

Mark Smith (Barrister-At-Law) said …

“Representative actions, where one person starts a case representing many others, who all want the answer to a legal question from a court such as ‘is this contract enforceable against me?’ but are not seeking damages. All those who sign up to the action will get the benefit of the win, but they do not have to start their own cases, as they are ‘represented’ by the lead claimant.

The only people who will definitely benefit from success in the case are those who have signed up. There will be no free rides. Any others will have to fight their own corners individually, either alone or with legal help (which will inevitably cost significantly more than the group case).”

Hi Mark,

Wrote to Nicole Blackmore, MP, OFT, Ombudsman, FCA, West Brom, sent chq to Justin etc The select Committee comment could be really useful, I personally cannot understand how the FCA are not taking a stance!

Does anyone have any email addresses or contact for the Treasury Select Committee? These members have the real power to influence the FCA. If anyone knows more, please post and we can all contact them to get things moving.

Ive just looked at the link you provided for FCA. I then went onto the website .

They have a email address

consumer.queries@fca.org.uk;

Perhaps it would be worth us all following up todays story in The Telegraph quickly while its fresh with an email to them .

If we can get 100+ emails in today following the Watchdog email link but just tailoring the last bit about it being a story we might get a little more action from them ?

I have just read the article in The Telegraph - http://www.telegraph.co.uk/finance/personalfinance/borrowing/mortgages/10381130/Watchdog-to-probe-tracker-mortgage-rate-rises.html

I have two questions for you please:-

1) Why hasn’t the FCA sought its own independent legal advice on the legalities over the Bank of Ireland decision to increase tracker rate differentials? The group organised by Property118, which funded the barristers opinion sent to you by Justin Selig at The Law society Firm “The Law Department” was sent to the Bank of Ireland and the FCA just accepted their QC’s defence. This is a “whitewash” and not the actions becoming of an industry regulator.
2) Why did the FCA’s spokesperson refuse to comment on whether the West Brom Mortgage Company had approached the FCA prior to notifying customers that they were intending to add 2% to their tracker mortgage margins on 1st December 2013?

With the fund at £31,000 that means that only 130 people have placed the required £240 into the pot. I am eager to put in but without knowing the direction of the action and the refund potential I am wary to blindly put the required £580 for my two mortgages. I hope the initial energy for this action suit is not waining.

Treasury Select Committe email address: Send your emails to ask why the FCA are not addressing our concerns re the Interest rate margin increase. Why are they not taking a stance?

What a strange post Neil.

You openly admit that you are sitting on the sidelines then complain that interest in the action could be waining even though we have seen a 50% increase in the fund in 24 hours. You then arrive at a figure of £580 which isn't even a multiple of £240.

Your other questions have been answered many times on this forum and are summarised in the update which was sent by email yesterday to all who expressed an interest in the Class Action by completing the registration form.

You don't work for the FCA or West Brom BS by any chance do you? LOL

It means 155 mortgages have been registered. Although its £240 there is £40 of that that is VAT.

If you have two mortgages that would be £480 not £580.

But look at it this way it will probably be the equic=valent on one months additional mortgage payment . About 10% of what you will pay every year from now til the end of your mortgage possibly , maybe another 20 years .

I understand its hard but if everyone thought like that the fund would be nil and you would definately be paying more and WB directors would be laughing their little B@@@o@@ks off at us all !!!

As the fund grows I think you will see more people who are worried chipping in and the fund grow faster . Dont hang on be part of it .

Hopefully todays Telegraph plus Marks mail shot to the Brokers will start to add new members to the site. Although there are probably around 120 -130 members signed up there are probably not that many more viewing this site . So the take up once we can get them to the site is probably very good.

You should bite the bullet and send off your payment but at the same time do everything you can think of and what as been suggested on this site to encourage more people onto here.

More publicity more people here more the fund will grow. If its gets big enough we may see WB backing down before much of the funds have been used so you will get a proportion back.

Dont have regrets about not contributing for the next 20 years

I don't work for either party. The £580 was clearly a slip on my iPhone. We were receiving emailed updates on the situation quite regularly and I haven't received one for a week or so. Unfortunately, I don't have time to read these threads constantly and so have welcomed the concise updates that have been being sent through. Probably easier to just place the link and not attack my post.
