West Bromwich Building Society Tracker Margins Legal Action

Are you affected by the West Brom Tracker Rate Hike?

If your mortgage account number begins with the number 8 you are highly likely to be one of the unlucky 41% of the mortgage customers of the West Bromwich building Society with a West Bromwich Mortgage Company account affected by the 1.9% increase in your tracker margin rate. However, if you arranged your mortgage directly with West Bromwich Building Society (i.e. not via a broker) or before 2006 the chances are that your account number will begin with the number 9 and you are not affected – YET!!! West Brom will give no assurances that mortgages with account numbers beginning with the number 9 will not be affected at some point in the future.

Tracker Rate Class Actions Updates

The reasons we started this campaign are very simple:-

1) We believe the actions of West Brom are immoral

2) We believe the actions of West Brom are unlawful, i.e. they have no legal grounds to increase their tracker rate margins

3) We have no wish to subsidise other areas of the West Bromwich Building Society business model

4) We are fearful of other lenders following suit if West Brom are allowed to get away with this

Mark Smith (Barrister-At-Law) said …

“Representative actions, where one person starts a case representing many others, who all want the answer to a legal question from a court such as ‘is this contract enforceable against me?’ but are not seeking damages. All those who sign up to the action will get the benefit of the win, but they do not have to start their own cases, as they are ‘represented’ by the lead claimant.

The only people who will definitely benefit from success in the case are those who have signed up. There will be no free rides. Any others will have to fight their own corners individually, either alone or with legal help (which will inevitably cost significantly more than the group case).”

The marketing fund is still slightly in deficit, supported by Property118 in good faith.

I doubt it will ever be sufficient to justify conventional mainstream advertising but Facebook advertising is next on the list if funds allow. We can advertise to friends of friends for a relatively low budget.

It's a high risk strategy as it could cause irreparable damage to your credit rating. On the flip side it could bring things to a head quicker. It's not a strategy I am likely to be using personally but I do know of one landlord who can afford to walk into court and if the judge rules against him he has the money to pay off the debt in full. He also has sufficient funds not to need to borrow again so isn't at all concerned about his credit rating. If you are in the same position you may be thinking the same way. At the end of the day it's your money, your future, your choice.

Ian. Yes it's now counting down to 200.

I really do not know why it does this. But I think once it hit 100 you could go on the site and search west Brom and it came up with our petition. Maybe more will take it higher up a hit list ?

If anyone does know I'd be happy to find out.

I've tried sending a group email to everyone who signed up. Let me know if it comes through. If that does work it gives me the opportunity to try and encourage a few more to the site to sign up for the class action. Ps aiming for 200 before lunch tomorrow now !!

If you right click on them you should get a number of options to do things with them copy or open in new tab to view at higher resolution also gives you the direct URL in the address bar to to copy and paste.

I can do even higher resolution if they are needed for print purposes.

infuriated landing,
i raised the issue of only paying the the pre rate rise interest payment after the rise date with wb during my hour long phone rant at the customer relations dept. i dont remember the actual legal terminology used or indeed the meaning of some of the phrases, ( as despite their claim of me being a sophisticated invester i am in fact a self employed decorator, more accustomed to anglo saxon language than legal talk) but the gist of his response was that if you were to carry out your threat then they can apply to take your rent, directly from your tenants. i would be interested to know if any one can throw any light on their claim. not that i think i would be a good idea to destroy my credit rating in doing so , but for those who are not so interested on their credit rating, their claim may well be of relevance.

There are several template letters on here, dont forget to include your £10 cheque to the West Bromwich.

It could be very important evidence to get everything disclosed that the company hold about you.

Please everybody who has any kind of mortgage with the West Bromwich submit your request ASAP.

Hi Folks
Another update (or yet another tuppence worth)
I have just received my response from the WBBS (with a PP from Holly bet she's getting tired) with the outlined (in yellow highlighter) sections. I have NEVER seen this document and I understand why. It' s not just the 1 condition they can change the interest rate on but their whim, but far more interestingly they deliberately try to get out of the idea that if the contract is biased to the person who writes it it actually is preferentially given to the person who does n't write it.para 27.1 (paraphrase even if we screw up it will be as if we hadn't) Mark explains this much better in his definition of the Latin.The T & C 's are written for a domestic mortgage para 12.1 "that YOU will occupy the Property) I certainly don't do you? Does this not mean that the actual T & C 's don't apply to BTL? There must surely be a stipulation as to which conditions are affected by which type of loan it is?

I only suggest this as a method of protesting and accompanied with letter of protest. West Brom would noit be able to collect at will and will attempt to chase for payments and they would likely charge extra and they have the power to effect credit score. But I am furious with West Brom, They must not be allowed to get away with this. If as many of the "6,700 club" plus industry bodies ARLA etc act with one voice and push for a class action, they might be stopped (might be) I agree that this is the beginning of the end for West Brom (RIP)
