West Bromwich Building Society Tracker Margins Legal Action

Are you affected by the West Brom Tracker Rate Hike?

If your mortgage account number begins with the number 8 you are highly likely to be one of the unlucky 41% of the mortgage customers of the West Bromwich building Society with a West Bromwich Mortgage Company account affected by the 1.9% increase in your tracker margin rate. However, if you arranged your mortgage directly with West Bromwich Building Society (i.e. not via a broker) or before 2006 the chances are that your account number will begin with the number 9 and you are not affected – YET!!! West Brom will give no assurances that mortgages with account numbers beginning with the number 9 will not be affected at some point in the future.

The reasons we started this campaign are very simple:-

1) We believe the actions of West Brom are immoral

2) We believe the actions of West Brom are unlawful, i.e. they have no legal grounds to increase their tracker rate margins

3) We have no wish to subsidise other areas of the West Bromwich Building Society business model

4) We are fearful of other lenders following suit if West Brom are allowed to get away with this

Mark Smith (Barrister-At-Law) said …

“Representative actions, where one person starts a case representing many others, who all want the answer to a legal question from a court such as ‘is this contract enforceable against me?’ but are not seeking damages. All those who sign up to the action will get the benefit of the win, but they do not have to start their own cases, as they are ‘represented’ by the lead claimant.

The only people who will definitely benefit from success in the case are those who have signed up. There will be no free rides. Any others will have to fight their own corners individually, either alone or with legal help (which will inevitably cost significantly more than the group case).”

As has been discussed the chances are that West Brom BS are monitoring this site. I'm concerned if they know how much money our case has. They may just have to out-spend to win, rather than win any legal argument.

On a separate point I've received my 'Information you need to know about your mortgage' booklet from the BS. Information which of course I didn't receive when I took out the mortgage in 2007. They use marker pen to highlight most of section 5 'The rate of interest'. However, beneath the highlighted area, at 5.4 it reads:

'If the rate of interest payable in respect of your loan is increased we will either increase your payment or will, with your agreement, make an alternative provision so that payment of the additional interest is made. For example, we may, with your agreement, extend the mortgage term. If the rate is reduced we will adjust your payment accordingly.'......

....heh, West Brom BS, I like your BS here. Why don't we extend my mortgage term? I'd be quite happy for you be saddled with me and my cheap mortgage for many more years to come.

Received a reply from my MP (Edward Timpson) essentially he says "This is an important matter and I have therefore written to the Chancellor of the Exchequer to ask for his investigation." and he has sent me a copy of the letter, so KEEP pushing your MP's as well.

I think you'll find they are talking about repayment mortgages, not interest-only mortgages, for one isn't paying off ANY capital of the principle loan, but purely interest. Therefore they can't possibly increase the term, as you'll be paying interest for the extra term too. So delaying, payment, or extending the term will have zero effect on what you pay per month, UNLESS they mean not to charge as much to you now, but more tomorrow, if you follow. I really cannot see how you'd get out of the cycle you'd then be in, even if this were true....it's my argument with them really, not you directly 🙂

Of course WBBS are monitoring this forum. It's about awareness to this fact - and certainly Mark and the legal team are aware of this.

WBBS certainly need to monitor what we are doing as I'm sure they know that they are going to need all the help they can get:-)

I think this open forum is good for generating interest and for general discussion.

However, as a contributor with 4 West Brom mortgages, I also think it now makes sense for there to be a separate, secure forum only accessible by those who have West Brom mortgages and who have sent their paperwork and fee to Justin.

This is for two reasons:

1. As has been discussed, there will be people with West Brom mortgages who are following the progress on this forum, but have not contributed. Basically looking for others to take the risk. They shouldn't benefit and need to pay up if they want to be on the inside track. Membership of the private forum will be an added incentive for them to contribute.

2. West Brom will be following this thread. It doesn't make sense for them to be aware of the progress or even the sentiments of those involved in the class action. This will undoubtedly become more sensitive as things progress, so why share information with them?

It's easy enough to set up a private forum, could be on this site, or a facebook group, or similar. Access by invitation only to those who have paid their £240 (or £480, etc).

Yes I thought about that but to make the members forum completely secure i.e. to prevent a West Brom stooge from paying £240 to join, it would need to open only to those who have sent paperwork to West Brom.

Whilst I think it's great that people have demonstrated solidarity by contributing even though not directly affected, the fact is that they don't have West Brom mortgages, so don't need to know exactly how things are progressing. They will of course find out in time the result, and would they really want to know the day to day detail anyway if not directly affected?

If there were a secure way of involving them then that would be ideal but I can't think of how this could be done.

I agree with Annette, I don't have a WBBS mortgage but I have contributed both to the fighting fund and the 'advertising ' fund. It is essential that WBBS are not allowed to get away with this and any assistance, from mortgage holders or others is very important. Anyone that has contributed should be included in the private thread.

Richard, I think I saw somewhere in previous posts, that if an out of court settlement was reached, there may well be a gagging clause, in which case those of us that have supported the cause but not held a mortgage would never know what the outcome was.
