West Bromwich Building Society Tracker Margins Legal Action

Are you affected by the West Brom Tracker Rate Hike?

If your mortgage account number begins with the number 8 you are highly likely to be one of the unlucky 41% of the mortgage customers of the West Bromwich building Society with a West Bromwich Mortgage Company account affected by the 1.9% increase in your tracker margin rate. However, if you arranged your mortgage directly with West Bromwich Building Society (i.e. not via a broker) or before 2006 the chances are that your account number will begin with the number 9 and you are not affected – YET!!! West Brom will give no assurances that mortgages with account numbers beginning with the number 9 will not be affected at some point in the future.

The reasons we started this campaign are very simple:-

1) We believe the actions of West Brom are immoral

2) We believe the actions of West Brom are unlawful, i.e. they have no legal grounds to increase their tracker rate margins

3) We have no wish to subsidise other areas of the West Bromwich Building Society business model

4) We are fearful of other lenders following suit if West Brom are allowed to get away with this

Mark Smith (Barrister-At-Law) said …

“Representative actions, where one person starts a case representing many others, who all want the answer to a legal question from a court such as ‘is this contract enforceable against me?’ but are not seeking damages. All those who sign up to the action will get the benefit of the win, but they do not have to start their own cases, as they are ‘represented’ by the lead claimant.

The only people who will definitely benefit from success in the case are those who have signed up. There will be no free rides. Any others will have to fight their own corners individually, either alone or with legal help (which will inevitably cost significantly more than the group case).”

We have today received WB's 2 'final response' letters for the 2 mortgages from Holly O'Sullivan their Customer Relations Officer (woudn't have her job for a pension) - with copies of a leaflet referring us to the Ombudsman if we're 'disappointed' with their response - containing the thinly veiled threat, their 'justification' and the revelation that they identified us as holders of multiple mortgages from their own data and that received from a credit reference agency and that they will 'continue to monitor market conditions and assess the rate they will charge us above base rate if (when) the BoE base rate rises'. They also enclosed the requested copies of the information booklets, mortgage deeds and copies of offer of loan stuff (so now I have that pertaining to the mortgage which I have somehow mislaid so I will send it off with a copy of their 2 page response letter)

Yes 81 & rising is really good after no more than two weeks. But we do need more. Thanks to Ed & Mark and others for finishing off the job of contacting all the landlords' Associations. Might draw some more in?
Questions:
1/. How many members of this forum if any have NOT signed up for the action? Their choice but would they care to say why not?
2/. Are there some WB BTL borrowers who despite it being stated in the forum will NOT benefit if not named in the action when we win, nevertheless still think they will so are sitting on the sidelines effectively freeloading? In all our ongoing PR efforts can we get a friendly journalist or anybody to make it more widely known that they are wrong?
3/. Are there still plenty of WB borrowers like us who, despite the publicity, remain blissfully unaware,of this forum and the class action who are just sitting resignedly preparing to accept the increase and pay? I reckon yes. Mark Alexander is planning a mailshot to mortgage brokers/advisors. Doubtless he has thought of it to include in the mailing a request that they forward a template letter/e mail to ALL their WB BTL clients exhorting them to join us here in the forum and the class action.

I will be sorting out papers and sending them off with a cheque to Justin Selig. The more money in the pot and the more members to the action the better chance of success. Indeed the more people who confirm that they were totally misled by the WB paperwork again supports the argument of misrepresentation which seems clearly to be the case.

Bit of a long shot but worth mentioning, in regards to the BOI and WB situation can the "contra proferentem rule" apply, This rule states,

Where there is doubt about the meaning of the contract, the words will be construed against the person who put them forward.

I see West Brom have actually lowered there mortgage rates to 1.89% for a 2 year fix! Bit of cheek seeing as they have just put your BTL trackers up claiming they need the money!

Not really a cheek at all. Wrong word. Part of the rip off scenario. Their new 2 yr fixed deal - for owner occupiers - makes them look good. BUT they need to be able to afford it. Where do they find the money? You've guessed it. From us!!!!!!!!!

Apologies to all you first movers ..... been crazy busy . Cheque and documents on the way to Justin tomorrow.

We have to stand up to this illegal bullying now or else ..B/ham midshires , mortgage express and on and on and.... scary what it could do to the whole market i reckon , not to mention our lives and assets ! !

This is gonna be huge .

If it fails my bags are packed ready !
