West Bromwich Building Society Tracker Margins Legal Action

Are you affected by the West Brom Tracker Rate Hike?

If your mortgage account number begins with the number 8 you are highly likely to be one of the unlucky 41% of the mortgage customers of the West Bromwich building Society with a West Bromwich Mortgage Company account affected by the 1.9% increase in your tracker margin rate. However, if you arranged your mortgage directly with West Bromwich Building Society (i.e. not via a broker) or before 2006 the chances are that your account number will begin with the number 9 and you are not affected – YET!!! West Brom will give no assurances that mortgages with account numbers beginning with the number 9 will not be affected at some point in the future.

Tracker Rate Class Actions Updates

The reasons we started this campaign are very simple:-

1) We believe the actions of West Brom are immoral

2) We believe the actions of West Brom are unlawful, i.e. they have no legal grounds to increase their tracker rate margins

3) We have no wish to subsidise other areas of the West Bromwich Building Society business model

4) We are fearful of other lenders following suit if West Brom are allowed to get away with this

Mark Smith (Barrister-At-Law) said …

“Representative actions, where one person starts a case representing many others, who all want the answer to a legal question from a court such as ‘is this contract enforceable against me?’ but are not seeking damages. All those who sign up to the action will get the benefit of the win, but they do not have to start their own cases, as they are ‘represented’ by the lead claimant.

The only people who will definitely benefit from success in the case are those who have signed up. There will be no free rides. Any others will have to fight their own corners individually, either alone or with legal help (which will inevitably cost significantly more than the group case).”

Ok were they aware you were talking about a BTL mortgage that they have written to you about with the 2% rise ?

I hope its right although no doubt someone at WB will say its a mistake . They can not be trusted the are lower than a snakes belly and have the morals of an alley cat

Just got an email back from the lady who runs the Gateshead Private Landlords Association and she is going to send an email to her members early next week on this plus put it on their website as mentioned yesterday

LEGAL ACTION UPDATE - 11 October 2013:

We have now received documentation from 81 borrowers in just one week - so well done to all those who have managed to get their documents together.

We now have a lot of reading and sorting to do which we will be doing over the course of next week. We are also finalising our letter to West Bromwich which I was hoping to send out today, but I have held back on having received such a great response in such a short a time. The more people we can say we are representing, the more likely WB are to listen to us.

I have been reading most of the comments being posted this week and also the emails I have been receiving. Please forgive me for not responding to all your emails. I have been inundated so have not had the time to respond to individual requests. I am in the process of putting a team together to enable us to respond quicker to your emails and phone calls, but this may be a couple of weeks before that is in place. I will continue to post weekly updates on this forum.

One point which has been raised which I would like to address is the point about whether or not to change your direct debits to standing orders so as not to allow WB to take out the increased payments come 1 December. If you do this, you do risk creating a black mark on your credit rating which may be hard to rectify in the future. On the positive side, it will bring matters to a head much quicker as it would require WB to instigate legal proceedings against you. Ultimately, it is a matter for you to decide whether or not you wish to take that risk. Our aim, should we issue proceedings would be to make a claim for a refund of any extra sums payable in any event.

I don't particularly want to rehearse the legal arguments on this forum, but your comments have been noted and will be taken into consideration when we put our instructions to counsel together. We hope to do this during the course of next week and will update you again in a week's time.
