West Bromwich Building Society Tracker Margins Legal Action

Are you affected by the West Brom Tracker Rate Hike?

If your mortgage account number begins with the number 8 you are highly likely to be one of the unlucky 41% of the mortgage customers of the West Bromwich building Society with a West Bromwich Mortgage Company account affected by the 1.9% increase in your tracker margin rate. However, if you arranged your mortgage directly with West Bromwich Building Society (i.e. not via a broker) or before 2006 the chances are that your account number will begin with the number 9 and you are not affected – YET!!! West Brom will give no assurances that mortgages with account numbers beginning with the number 9 will not be affected at some point in the future.

The reasons we started this campaign are very simple:-

1) We believe the actions of West Brom are immoral

2) We believe the actions of West Brom are unlawful, i.e. they have no legal grounds to increase their tracker rate margins

3) We have no wish to subsidise other areas of the West Bromwich Building Society business model

4) We are fearful of other lenders following suit if West Brom are allowed to get away with this

Mark Smith (Barrister-At-Law) said …

“Representative actions, where one person starts a case representing many others, who all want the answer to a legal question from a court such as ‘is this contract enforceable against me?’ but are not seeking damages. All those who sign up to the action will get the benefit of the win, but they do not have to start their own cases, as they are ‘represented’ by the lead claimant.

The only people who will definitely benefit from success in the case are those who have signed up. There will be no free rides. Any others will have to fight their own corners individually, either alone or with legal help (which will inevitably cost significantly more than the group case).”

Remember, as I have stated earlier, whatEVER happens to WBBS, we ought not to care nor worry. The reason being that whether it's taken over by another government bailout (taxpayer's money in other words) or bought out by another bank, part of this would be to honour existing loans and mortgages under existing conditions. A new owner can't simply change the rules - or WBBS, and any other organisation wanting to get out of their obligations, could pull the same trick. It won't and simply cannot legally happen! So don't be ruled by fear and/or things going pear shape if WBBS go under. Whatever happens your mortgage will be protected as it currently is.

So the outcome of this Class Action, when ruling against WBBS, is not going to stand you in a weaker position than you're in now, just because they can't run their business properly. We can't be made to pay for their erroneous ways, any more than they can't be made to pay for ours.

I received a copy of the terms and conditions today which they hadn't even bothered to staple! I have written back to ask them to provide evidence of where I signed and acknowledged the terms and conditions - I had asked for a copy of my mortgage deed but so far this has not been forthcoming.

I have also sent off the letter asking for them to send all information they hold on my husband and myself in relation to the mortgage.

All good points thank you.

My concern was encouraging everyone to withdraw funds from WBBS. A run on them Like the Peston inspired Northern rock scenario could breed desperation and it is harder to fight someone with nothing to lose.

Otherwise I am outraged and say let's make an example of them for the individual man/woman on the street.

We are all in this mess because of the Banks and now they want customers to pay for their mistakes! Utterly disgraceful. (just to make my position clear).

I have just completed our 2nd complaint letter to WBBS asking that they address our questions and concerns carefully, requested copies of all data they hold on us, emailed Watchdog, Martin Lewis and Money Box and written to Hugh Robertson our MP, George Osborne, Ed Milliband, Nick Clegg and David Cameron. Now does anyone have a template letter for the Bank of England?

On the suggestion of others on here I have now written to my MP (Pete Wishart), and my MSP (John Swinney), plus sent a data request with a £10 cheque to West Bromwich.

Let's keep up the momentum - this is a battle we must win!

Yes. I saw that but I had already sent it. But to be honest I just want to pile as much pressure on them as possible without giving them an excuse not to do it. I hope others will follow either way sending the cheque or not. Just cause them as much work as possible.

I keep banging on about it but make no excuses. Write to MPs. PM. CHANCELLOR. Papers. Tv and radio. Bank of England. Keep up the pressure

I'm going to ask mark tomorrow whether we ought be be telling our solicitors and mortgage brokers plus enact who I think dealt with a lot of the re mortgages to put their professional indemnity insurers on alert.

Potentially WB stand to make an additional £15m per annum. If that was passed to the insurance companies that's a lot. If we could encourage these companies to put a fraction of that into the fund we would have more than enough to fight these immoral greedy B@@@74@@ds

Thanks for digging out the Res Mortgage Backed Securitising structure of our beloved lifetime trackers.

In the following links, there are several contacts at Moody's and also the Company Directorship details of the Jersey based SPV (Hawthorn) holding/owning the income cash flow from our mortgage payments.

As WBBS were the 'originators' of the lifetime tracker mortgages, is it worth starting to cause a little inconvenience and aggravation in the Top Co ownership structure of the bond issuers and ultimate owners ? At this stage, I would imagine they are oblivious (and probably do not care yet) of the growing dissatisfaction of the WBBS (and Hawthorn endorsed) business decision to hike our rates.

In addition, maybe a well thought through response of our legal position to cause issues and Moodys et al of the ratings of these notes ????

Just read the article, well done to Sam.

I've left a comment to direct people back here, I request others to do the same please, adding comments on feelings about what's happening and our fears that other lender will follow suit. We need to get in quick before The Mail's landlord haters hijack the thread.
