West Bromwich Building Society Tracker Margins Legal Action

Are you affected by the West Brom Tracker Rate Hike?

If your mortgage account number begins with the number 8 you are highly likely to be one of the unlucky 41% of the mortgage customers of the West Bromwich building Society with a West Bromwich Mortgage Company account affected by the 1.9% increase in your tracker margin rate. However, if you arranged your mortgage directly with West Bromwich Building Society (i.e. not via a broker) or before 2006 the chances are that your account number will begin with the number 9 and you are not affected – YET!!! West Brom will give no assurances that mortgages with account numbers beginning with the number 9 will not be affected at some point in the future.

OUR INTENDED CLASS ACTION LITIGATION OVERVIEW

Tracker Rate Class Actions Updates

The reasons we started this campaign are very simple:-

1) We believe the actions of West Brom are immoral

2) We believe the actions of West Brom are unlawful, i.e. they have no legal grounds to increase their tracker rate margins

3) We have no wish to subsidise other areas of the West Bromwich Building Society business model

4) We are fearful of other lenders following suit if West Brom are allowed to get away with this

Mark Smith (Barrister-At-Law) said …

“Representative actions, where one person starts a case representing many others, who all want the answer to a legal question from a court such as ‘is this contract enforceable against me?’ but are not seeking damages. All those who sign up to the action will get the benefit of the win, but they do not have to start their own cases, as they are ‘represented’ by the lead claimant.

The only people who will definitely benefit from success in the case are those who have signed up. There will be no free rides. Any others will have to fight their own corners individually, either alone or with legal help (which will inevitably cost significantly more than the group case).”

Ok, so it looks like the Data Protection Act "Subject Access Request" is a useful tool for us to obtain information.

All 6,700 of us must put this application in to the West Brom.

They could well be holding important information useful in our defence.

The fact it may bog them down in paperwork is of course, no concern of mine.

Please encourage all those affected to write in with the request....

I know from the CoOp retail bondholders campaign over on

that campaigners have sucessfully been in email contact with him, on the back of which he has run stories.

It may be worth following him on twitter and referring to this campaign that way as well.

If we can all email him, again 6,700 emails, he may take notice...

The West Bromwich Building Society – “Your Business Decision to change the interest rate on Life Time Tracker Mortgages”

Dear Mr Westhoff

I am a consumer that has been targeted by your company’s business decision to change the interest rate that is currently applied to my fixed premium lifetime tracker mortgage account.

The West Bromwich Building Society mentions that your decision was only made after all considerations has been taken into account and you believe this is a fair reflection to attempt to pass on your extra funding costs to myself and 6,999 other customers.

I would like to invite you to highlight in detail what you actually refer to all ‘considerations’ had been taken into account before making this business decision ? In addition, please can you confirm what the potential benefits and liabilities were concluded upon in making your final business decision in this regard ?

As your business decision will be provoking legal action against the West Bromwich Building Society from the targeted consumers, I would seek your assurances that if for any reason the Courts of Law in the UK decide that your ‘business decision’ to be unlawful and you would have ultimately bought the Retail Mortgage Market and The West Bromwich Building Society into disrepute, will you be offering your full resignation from the board of The West Bromwich Building Society ?

Is the anyone with a background in PR - as in Public Relations - who would help. I think that as many of us are saturating the press if he were in agreement it might be a good idea for Mark to be available to discuss the issue on TV and radio. The Today programme and Andrew Marr's Politics Show come to mind and a bit of coverage on Bloomberg would be great. Mark, do you think this would be of use and is there anyone who could help set something up?

That is a very good idea, getting those TV and Radio interviews will really really help push this into the public domain.

There are 2 fights to fight here... the first is the legal fight, and second is the media and PR fight. In many ways it is the media and PR which could well be more important than the first.....
Of course we have to fight the legal route as well, but if this gets taken up by the powers that be, it makes it a whole lot harder for the West Brom to defend.

If they do it to buy to let landlords this time, next time it will be normal mortgage holders, and that's a large percentage of the population....
