West Bromwich Building Society Tracker Margins Legal Action

Are you affected by the West Brom Tracker Rate Hike?

If your mortgage account number begins with the number 8 you are highly likely to be one of the unlucky 41% of the mortgage customers of the West Bromwich building Society with a West Bromwich Mortgage Company account affected by the 1.9% increase in your tracker margin rate. However, if you arranged your mortgage directly with West Bromwich Building Society (i.e. not via a broker) or before 2006 the chances are that your account number will begin with the number 9 and you are not affected – YET!!! West Brom will give no assurances that mortgages with account numbers beginning with the number 9 will not be affected at some point in the future.

Tracker Rate Class Actions Updates

The reasons we started this campaign are very simple:-

1) We believe the actions of West Brom are immoral

2) We believe the actions of West Brom are unlawful, i.e. they have no legal grounds to increase their tracker rate margins

3) We have no wish to subsidise other areas of the West Bromwich Building Society business model

4) We are fearful of other lenders following suit if West Brom are allowed to get away with this

Mark Smith (Barrister-At-Law) said …

“Representative actions, where one person starts a case representing many others, who all want the answer to a legal question from a court such as ‘is this contract enforceable against me?’ but are not seeking damages. All those who sign up to the action will get the benefit of the win, but they do not have to start their own cases, as they are ‘represented’ by the lead claimant.

The only people who will definitely benefit from success in the case are those who have signed up. There will be no free rides. Any others will have to fight their own corners individually, either alone or with legal help (which will inevitably cost significantly more than the group case).”

I think you're asking the wrong question.

I might agree with a particular action but disagree with the extent to which it is done.

The question is whether the things which are being done are above and beyond that which is needed for this campaign.

This being in the context of having so much in place already and achieved so much.

History shows that EDM's tend always to receive more support from opposition party MP's. The subsequent debates often offer an opportunity, as will ours, for having a mini pop at the government.

It's the total numbers that count for us. So far so good.

This is the tip of the iceberg, the pressure on West Brom will grow 10 fold by the week from now on because that is what several thousands of people including those affected, those not affected (YET!), advisers, media and politicians want to happen. I will continue to do my bit and help increase or facilitate that pressure wherever possible as I have done since day one.

If the campaign group are beginning to rattle cages that can only be a good thing.

If the West Brom wish to punish my actions by calling in my loan then so be it!

NEXT SUGGESTION

I will draft an email template for volunteers to send to ALL 650 MP's, the task can be broken down in much the same way as we did earlier on in this campaign when we contacted the Landlords associations.

All MP's deserve to receive a copy of the MP's briefing notes so that they can be well prepared for the 90 minute debate when it happens. Together with the legal team I will also help to prepare a more detailed follow up to launch nearer the date of the 90 minute debate when we get a date and time allocated. Please note the use of the word WHEN and not IF. This is virtually a foregone conclusion now.

Hi All
I now know how low and dispicable WBBS can get. Also this post will answer a few questions that have been asked over the last couple of days.
I have just received a reply from WBBS to my letter and pro forma showing my CURRENT portfolio. I currently have 2 BTL's having sold 1 in January 2014. They have now stated that as thier criteria was as set on September 2013 I am still within the criteria! And that the increase in the interest rate is still applicable.

I am to say the least gutted. But even more determined that we should win the case against them.

Richard, nothing extra we do can do any harm whatsoever, Some initiatives may be more productive than others agreed but you seem to be saying we should sit back now?

Consistent action on all fronts can only inch us forward on a daily basis. There are plenty of examples of campaigns appearing to be dead or dying in the past when observers note things have gone quiet.

Action keeps the momentum up. If anybody suggested something that might be harmful I am sure Mark, or someone, would nip it in the bud.

There is no need to speak by email as I won't say anything here that would be embarrassing 🙂

Rattling cages is great 🙂

But I have seen a lot of talk on here regarding replying to replies upon replies from lenders and MP's. That sounds great on face value.

However, when someone keeps sending letter after letter to the same MP and the lender it has a two fold effect.

1. It can be demoralising for the borrower when they keep receiving negative replies

2. It can lessen the effect of the original complaint or point of view that the borrower brought in the first instance

Now, this is all fine if you win the case and I hope and expect you will 🙂 You might look back and say it was worth it.

But if you don't this is a lot of people doing a lot of work for nothing.

I say this in the context of the legal action which is now in sight. I would not have said that 6 months ago.

Hi Terry I can fully understand that you are gutted I would be. However this does not come as any surprise to me as I have recently said on this forum WBBS are pinning everything on our property portfolio as at September 2013 and they couldn't care less what our property portfolio was when we took out our mortgage with them and they couldn't now care less what it is today, next month or next year.
