West Bromwich Building Society Tracker Margins Legal Action

Are you affected by the West Brom Tracker Rate Hike?

If your mortgage account number begins with the number 8 you are highly likely to be one of the unlucky 41% of the mortgage customers of the West Bromwich building Society with a West Bromwich Mortgage Company account affected by the 1.9% increase in your tracker margin rate. However, if you arranged your mortgage directly with West Bromwich Building Society (i.e. not via a broker) or before 2006 the chances are that your account number will begin with the number 9 and you are not affected – YET!!! West Brom will give no assurances that mortgages with account numbers beginning with the number 9 will not be affected at some point in the future.

Tracker Rate Class Actions Updates

The reasons we started this campaign are very simple:-

1) We believe the actions of West Brom are immoral

2) We believe the actions of West Brom are unlawful, i.e. they have no legal grounds to increase their tracker rate margins

3) We have no wish to subsidise other areas of the West Bromwich Building Society business model

4) We are fearful of other lenders following suit if West Brom are allowed to get away with this

Mark Smith (Barrister-At-Law) said …

“Representative actions, where one person starts a case representing many others, who all want the answer to a legal question from a court such as ‘is this contract enforceable against me?’ but are not seeking damages. All those who sign up to the action will get the benefit of the win, but they do not have to start their own cases, as they are ‘represented’ by the lead claimant.

The only people who will definitely benefit from success in the case are those who have signed up. There will be no free rides. Any others will have to fight their own corners individually, either alone or with legal help (which will inevitably cost significantly more than the group case).”

Just for information and inspiration it's interesting to see how the process of securing a debate works at the Back Bench Business Committee (I believe this is the process that will be used)

http://www.parliament.uk/bbcom .The transcripts of representations give an insight in to the considerations. One being, how many MP's are going to join in the debate.

Hence, the need to ask for our own MP's support.

Just wondering if anyone is still having a problem getting their MP to sign the EDM now ?

I have been chasing David Blunkett for over three weeks. I don't think it was ever an issue him not signing , just he was so busy it took that long for my requests to get to him

Dean, I'm still chasing Justine Greening for confirmation of her support for the debate, although I've been away for a little while so have only done so again today. Like several others, she can't sign the EDM because she is a minister (the EDM numbers on their own don't tell the full story!), but if I can get her confirmed support I'll be very pleased indeed. Fingers crossed and will keep you posted!

and http://www.parliament.uk/business/committees/committees-a-z/commons-select/backbench-business-committee/suggesting-debates/ makes it clearer.

Dean, I think it is up to select committees to conduct enquires that can insist people attending for questioning. So It would be the treasury select committee that could decide to call in WB and we could watch some squirming on telly. The select committees are independent from the associated department so the current brush off from the treasury should not effect the opinion of the committee.

I'd be tempted to attend in person, space permitting. There has always been spare capacity at meetings of the PAC that I have attended in the past.

Has anybody got a copy of the infamous booklet " Information you need to know about your Mortgage " Like many, I did not ever receive a copy. I am about to send my pack to the FOS and would like to enclose a copy.

Have heard from Geoffrey Clifton Brown (Cotswold) exceedingly long letter but nothing interesting. Basically government doesn't intervene in lenders commercial decisions.Treasury only sets framework. FCA investigated, decided BOI change was OK, (no mention WBBS.) Mortgage regs. 2004 drew distinction between buy to let and homeowners (he missed point some were homeowners) Government committed to minimising regulatory burden to avoid imposing additional costs on business that ultimately leads to higher costs to customers. That we could contact money advice service. EDM's cost too much and he rarely signs.

I'm pretty sure an MP or group of MP's cannot compel anyone to meet them to explain themselves. They could ask but the request could be refused.

Probably what you are thinking of is where naughty boys get called to sit in front of Select Committees and are questioned byn MP's. Whether that will ever happen in our case remains to be seen, Probably unlikely.

Hauling over the coals of WB should be done by B of E and/or FCA but won't likely happen sadly.

Our situation is a classic example of "If you want a job doing you had better do it yourself".
