West Bromwich Building Society Tracker Margins Legal Action

Are you affected by the West Brom Tracker Rate Hike?

If your mortgage account number begins with the number 8 you are highly likely to be one of the unlucky 41% of the mortgage customers of the West Bromwich building Society with a West Bromwich Mortgage Company account affected by the 1.9% increase in your tracker margin rate. However, if you arranged your mortgage directly with West Bromwich Building Society (i.e. not via a broker) or before 2006 the chances are that your account number will begin with the number 9 and you are not affected – YET!!! West Brom will give no assurances that mortgages with account numbers beginning with the number 9 will not be affected at some point in the future.

Tracker Rate Class Actions Updates

The reasons we started this campaign are very simple:-

1) We believe the actions of West Brom are immoral

2) We believe the actions of West Brom are unlawful, i.e. they have no legal grounds to increase their tracker rate margins

3) We have no wish to subsidise other areas of the West Bromwich Building Society business model

4) We are fearful of other lenders following suit if West Brom are allowed to get away with this

Mark Smith (Barrister-At-Law) said …

“Representative actions, where one person starts a case representing many others, who all want the answer to a legal question from a court such as ‘is this contract enforceable against me?’ but are not seeking damages. All those who sign up to the action will get the benefit of the win, but they do not have to start their own cases, as they are ‘represented’ by the lead claimant.

The only people who will definitely benefit from success in the case are those who have signed up. There will be no free rides. Any others will have to fight their own corners individually, either alone or with legal help (which will inevitably cost significantly more than the group case).”

Nothing earth-shattering to report here, but to let you know I've heard back from my MP, Ian Murray, MP for Edinburgh South.

His reply as follows:

Dear Kevin,

Thanks for your email regarding the issue of mortgage tracker rate hikes.

I was very concerned to hear about this. Many people choose a “tracker” mortgage to give them stability and assurance in their mortgage repayments. Indeed, I understand that West Brom Building Society, one of the firms embroiled in the issue, have stated such in their adverts - "Tracker mortgages give you the certainty of knowing that the rate you pay will move in line with bank base rate." It can’t be right that they then try to increase their rates, which creates uncertainty for people.

I understand the Financial Conduct Authority (FCA) is investigating these cases and I hope they do so thoroughly, and if any wrongdoing is discovered then appropriate action must be taken. As a Shadow frontbencher I am unable to sign EDMs due to parliamentary protocol, however, I shall certainly write to the Chancellor to raise your concerns and to ask for his response.

If I can help further in the meantime, please do let me know.

Really feels like we are on a roll with the number of MP's now supporting us! How long can the FCA continue to sit on their hands under all this pressure?
I spoke with Clare Jose (Team Leader at FOS) recently and I get the impression they are keen to help, just weighed down by bureaucracy.
I am pleased to see that Ian Murray MP has picked up on the West Brom's advertising “Tracker mortgages give you the certainty of knowing that the rate you pay will move in line with bank base rate.” ...It can’t be right that they then try to increase their rates, which creates uncertainty for people 🙂

Had a reply back from David Blunkett today. Says he as signed the EDM. Also sent me a copy of the letter he got back from west Brom. He asked Westoff for a meeting but Westoff declined.

Not got the guts to talk to someone face to face on this. Hiding behind his group risk director.

Might there be a chance that MPs could demand a meeting with West Broms board and get them to explain themselves ?

I will expand more tomorrow.
