West Bromwich Building Society Tracker Margins Legal Action

Are you affected by the West Brom Tracker Rate Hike?

If your mortgage account number begins with the number 8 you are highly likely to be one of the unlucky 41% of the mortgage customers of the West Bromwich building Society with a West Bromwich Mortgage Company account affected by the 1.9% increase in your tracker margin rate. However, if you arranged your mortgage directly with West Bromwich Building Society (i.e. not via a broker) or before 2006 the chances are that your account number will begin with the number 9 and you are not affected – YET!!! West Brom will give no assurances that mortgages with account numbers beginning with the number 9 will not be affected at some point in the future.

Tracker Rate Class Actions Updates

The reasons we started this campaign are very simple:-

1) We believe the actions of West Brom are immoral

2) We believe the actions of West Brom are unlawful, i.e. they have no legal grounds to increase their tracker rate margins

3) We have no wish to subsidise other areas of the West Bromwich Building Society business model

4) We are fearful of other lenders following suit if West Brom are allowed to get away with this

Mark Smith (Barrister-At-Law) said …

“Representative actions, where one person starts a case representing many others, who all want the answer to a legal question from a court such as ‘is this contract enforceable against me?’ but are not seeking damages. All those who sign up to the action will get the benefit of the win, but they do not have to start their own cases, as they are ‘represented’ by the lead claimant.

The only people who will definitely benefit from success in the case are those who have signed up. There will be no free rides. Any others will have to fight their own corners individually, either alone or with legal help (which will inevitably cost significantly more than the group case).”

ADVICE TO MEMBERS

Advice from Justin and our QC has now been distributed to members who are fully paid. I was privvy to the proposed communication over the weekend so I am a few days ahead of you all. I was also privvy to a tele-conference between all of our professional advisers last week when strategies were discussed.

The communication from Justin today must NOT be discussed on this forum for the reasons advised in Justin's email. Unaffected contributors to the marketing campaign will be appraised in due course but for legal reasons this is not currently possible so please bear with us.

As a result of todays communication I am being bombarded with emails requesting a secure members forum and/or a meeting of members for affected members. I will look into this further over the next few days and get back to you all in due course.

I am in support of the proposed strategies and when we meet or get a secure forum running I will be only too pleased to explain why. There is a lot more thought behind the proposed strategy than has been communicated so far.

Your patience is very much appreciated.

That's a good article and did you notice the part which said.......

"The Committee was won over by Which?’s example of Bank of Ireland and called for the scenario to be added to a grey list of terms used to assist a court when considering the application of the fairness test to a particular case"

I wonder whether this "Grey list" will be included in time for the West Brom legal action.

I probably preparing my own noose here but if members want to email mail me I will do my best to respond as quickly as possible.

I would ask all members to note that Justin charges whereas I do not. Let's keep our fund intact as far as possible please. If I don't know an answer I can find out from Justin and will then be able to answer the same question to several members who ask it. I've been in the thick of this this from day one though so I suspect I know the answers to most questions. Remember, I have also read the full QC's opinion and had literally hundreds of emails and telephone conversations with Justin.
