West Bromwich Building Society Tracker Margins Legal Action

Are you affected by the West Brom Tracker Rate Hike?

If your mortgage account number begins with the number 8 you are highly likely to be one of the unlucky 41% of the mortgage customers of the West Bromwich building Society with a West Bromwich Mortgage Company account affected by the 1.9% increase in your tracker margin rate. However, if you arranged your mortgage directly with West Bromwich Building Society (i.e. not via a broker) or before 2006 the chances are that your account number will begin with the number 9 and you are not affected – YET!!! West Brom will give no assurances that mortgages with account numbers beginning with the number 9 will not be affected at some point in the future.

Tracker Rate Class Actions Updates

The reasons we started this campaign are very simple:-

1) We believe the actions of West Brom are immoral

2) We believe the actions of West Brom are unlawful, i.e. they have no legal grounds to increase their tracker rate margins

3) We have no wish to subsidise other areas of the West Bromwich Building Society business model

4) We are fearful of other lenders following suit if West Brom are allowed to get away with this

Mark Smith (Barrister-At-Law) said …

“Representative actions, where one person starts a case representing many others, who all want the answer to a legal question from a court such as ‘is this contract enforceable against me?’ but are not seeking damages. All those who sign up to the action will get the benefit of the win, but they do not have to start their own cases, as they are ‘represented’ by the lead claimant.

The only people who will definitely benefit from success in the case are those who have signed up. There will be no free rides. Any others will have to fight their own corners individually, either alone or with legal help (which will inevitably cost significantly more than the group case).”

We will NOT settle on any basis.

I can't find it but if you search Google for "West Brom mortgage hike" you will see Google is filled with search results about the hike!

I've looked as far a 5 pages deep and the results are consistent.

In fact just searching "West Brom Mortgages" gives a plethora of negative advertising for them.

The man hours and effort that has been put in by some forum members to produce this sort of coverage is staggering.

I hope the negative impact on their sales outweighs any profit gained by the hike.

If I were looking for a mortgage lender and knew nothing about the hike I would avoid West Brom based on the Google results alone!

In fact I'm hoping that the West Brom Advertising wing offer each of Mark Alexander and his core of supporters a job!

Even as a goodwill gesture.

They're doing a much better job than the existing advertising team. 🙂

I'm thinking our MP, Hugh Robertson, may be feeling a tad ??? by the constant barrage of letters and e-mails I send, as today's HoC letter says: Thank you for your latest e-mail dates 22nd Jan about the WBBS. It was kind of you, as always, to let me have your views. I will certainly discuss this issue and the points you raise with Jason McCartney when I see him next....' (am I sensing raised eyebrows here??? Hope not because Hugh seemed to be quite supportive when we started this fiasco)

Dame Anne Begg Aberdeen South has written saying she's signed the EDM and should a debate take place she is more than happy to attend and voice my concerns.
I'll thank her and ask her to contact David Morris and Jason McCartney MPs about applying for 90 minute debate.

Just been out to buy the Times - here is the article for anyone who doesn't get around to buying it:

"When West Bromwich Building Society and Bank of Ireland (BoI) increased rates for buy-to-let borrowers on their tracker mortgages last year there was much outrage but little action to prevent it happening again. But earlier this week Mark Alexander, behind a campaign on property118.com against West Brom's move, met David Morris, Tory MP for Morecambe and Lunesdale, who has now launched an Early Day Motion (EDM) condemning "mortgage lenders breaching tracker rate mortgage contracts". It is unlikely to succeed but this issue deserves to be aired in Parliament as it would put press on the Financial Conduct Authority to tighten the rules. Contact your MP and ask them to support EDM 976 if you want it to happen."
