West Bromwich Building Society Tracker Margins Legal Action

Are you affected by the West Brom Tracker Rate Hike?

If your mortgage account number begins with the number 8 you are highly likely to be one of the unlucky 41% of the mortgage customers of the West Bromwich building Society with a West Bromwich Mortgage Company account affected by the 1.9% increase in your tracker margin rate. However, if you arranged your mortgage directly with West Bromwich Building Society (i.e. not via a broker) or before 2006 the chances are that your account number will begin with the number 9 and you are not affected – YET!!! West Brom will give no assurances that mortgages with account numbers beginning with the number 9 will not be affected at some point in the future.

The reasons we started this campaign are very simple:-

1) We believe the actions of West Brom are immoral

2) We believe the actions of West Brom are unlawful, i.e. they have no legal grounds to increase their tracker rate margins

3) We have no wish to subsidise other areas of the West Bromwich Building Society business model

4) We are fearful of other lenders following suit if West Brom are allowed to get away with this

Mark Smith (Barrister-At-Law) said …

“Representative actions, where one person starts a case representing many others, who all want the answer to a legal question from a court such as ‘is this contract enforceable against me?’ but are not seeking damages. All those who sign up to the action will get the benefit of the win, but they do not have to start their own cases, as they are ‘represented’ by the lead claimant.

The only people who will definitely benefit from success in the case are those who have signed up. There will be no free rides. Any others will have to fight their own corners individually, either alone or with legal help (which will inevitably cost significantly more than the group case).”

Email sent to my MP in respect of supporting Early Day Motion number 976 and I will be following it up with a phonecall to my MP later.

Donation also made to the marketing fund as we can't be wining and dining our elected representatives at McDonalds. It's just not cricket!

On a more serious note, getting the support of MP's and getting a debate going on the conduct of mortgage lenders like the West Brom and Bank of Ireland is excellent work and I look forward to the publicity this will generate. However, please bear in mind that the West Brom will still be banking on a belief that we will be unable to raise the funds for a protracted legal battle in the courts. I would urge all members of the class action to keep some funds to one side as it may become necessary to pass the collection plate around again for the appellate courts. Civil actions are an expensive business and we will need to raise funds for the invariable appeal to our victory at first instance.

It wont be west Brom getting concerned it will be the majority of the West Brom board of directors who are concerned. Those that voted for this immoral rise .

They will have thought that they could bully the borrowers into paying these additional amounts. Increased the revenue income , look great on their CVs and push up their bonus and salary. Then when that succeeded move onto the accounts beginning with 9.

If this adverse publicity continues its unlikely any reputable Financial Institution will touch them. They will be out of well paid jobs with little prospect of gaining similar employment.

If I were one of the minority directors opposed to this rise I would be asking questions of the others and pointing to my objections. I would be looking to get these people out of the Society and rid it of this stigma before its forced into being taken over and my own reputation was tarnished.

I can not believe they ever anticipated this much fuss, publicity and funds would ever be raised. Their "external legal advisors " should be checking over their PII policies too !!

If we have 400 or so members of the group action and each member contributes an additional £1000, that's £400,000. Add that to the £100,000+ already raised and you have over half a million. A considerable war chest by any account and one that would nicely see us from the High Court through to the Court of Appeal and through to the Supreme Court if that ever became necessary.

Which is why it is so vitally important that everyone involved in the group action keep some funds in reserve. £100,000 is a lot of money for us but it's chickenfeed for the West Brom. Half a million in the coffers and a fully funded legal case? Then Johnathan Westoff, Andrew Jones, and the rest of the board of the West Brom that were complicit in this scam will start to experience the same cold sweats we did when we received the rate hike letters last year.

Payback's a bitch!

Justin confirmed this morning that funds on account are in excess of £100,000 even after having paid for significant advice to date.

I expect the fund to grow quickly again now given the media attention we will again be attracting.

Keeping money is reserve is never a bad idea though 🙂

The response to the fund raising for the marketing fund has started off well too with nearly £500 having been raised in the last few hours. That will soon get swallowed up though so we need EVERYBODY to dig deep and support this.

I will make time for this but I need to begin to cover my costs now as I'm sure everybody will appreciate.

My target for the marketing fund is to raise circa £20k which should pay for up to 30 visits to London and associated expenses for travel, entertaining centre's of influence etc.
