West Bromwich Building Society Tracker Margins Legal Action

Are you affected by the West Brom Tracker Rate Hike?

If your mortgage account number begins with the number 8 you are highly likely to be one of the unlucky 41% of the mortgage customers of the West Bromwich building Society with a West Bromwich Mortgage Company account affected by the 1.9% increase in your tracker margin rate. However, if you arranged your mortgage directly with West Bromwich Building Society (i.e. not via a broker) or before 2006 the chances are that your account number will begin with the number 9 and you are not affected – YET!!! West Brom will give no assurances that mortgages with account numbers beginning with the number 9 will not be affected at some point in the future.

Tracker Rate Class Actions Updates

The reasons we started this campaign are very simple:-

1) We believe the actions of West Brom are immoral

2) We believe the actions of West Brom are unlawful, i.e. they have no legal grounds to increase their tracker rate margins

3) We have no wish to subsidise other areas of the West Bromwich Building Society business model

4) We are fearful of other lenders following suit if West Brom are allowed to get away with this

Mark Smith (Barrister-At-Law) said …

“Representative actions, where one person starts a case representing many others, who all want the answer to a legal question from a court such as ‘is this contract enforceable against me?’ but are not seeking damages. All those who sign up to the action will get the benefit of the win, but they do not have to start their own cases, as they are ‘represented’ by the lead claimant.

The only people who will definitely benefit from success in the case are those who have signed up. There will be no free rides. Any others will have to fight their own corners individually, either alone or with legal help (which will inevitably cost significantly more than the group case).”

I have just spoken to David Butterworth at The Times. He is very interested in reporting feedback from my MP's briefing tomorrow and we have agreed to chat again at 9:30 am on Wednesday this week 🙂

I have also had email correspondence from FT Adviser and Cherryfind today.

LEGAL ACTION UPDATE:

As you will be aware, we received the opinion from our QC just before Christmas. I am sorry you have not heard from us since then, but we have been devising the best way forward before providing our clients with our advice.

We have a further conference call with our QC scheduled for Thursday morning and then aim to email our clients by the end of the week with our proposed course of action together with the suggested complaint forms and covering letters to send to the Financial Ombudsman Service. The advice will not be posted on the forum but will be emailed directly to everyone who has signed up with us, and we would request that the forum is not used to discuss our advice to ensure that our professional privilege is retained.

Thank you for bearing with us, but we want to ensure our clients have the best advice possible rather than rushing things.

Just to say, well done with the MP's and all the best with the briefing Mark. It'll be strange / hypocritical if they don't want to take up the cause after all the other banking stories that keep coming out. It's a chance for them to actually make a difference rather than just commenting and throwing blame in the aftermath.

I don't think West Brom ever thought we would get to this stage. It's almost incredible that in just a few short months we have collectively managed to kick up more of a fuss than anyone has managed in the past and done more than all the regulators put together. Onwards and upwards.

Hi Andy

All of the MP's attending the briefing are those who intend to help us fight our case. For them, the briefing is to seek ammunition to help us in our fight. For me, it's to fulfil their requirement and to gain a better understanding of what they believe they will be able to achieve as a result of having the debate.

Mark Alexander, you are going to be famous when all this is over!!!! :):):)

I've been out of touch with this for a week or so. However I've emailed my MP Nick Gibb again about tomorrows briefing. You'd never know he may come along. Unfortunately like others I don't think he quite understood what our argument was about from previous letters. I've gave him a more personal summary this time around.
