West Bromwich Building Society Tracker Margins Legal Action

Are you affected by the West Brom Tracker Rate Hike?

If your mortgage account number begins with the number 8 you are highly likely to be one of the unlucky 41% of the mortgage customers of the West Bromwich building Society with a West Bromwich Mortgage Company account affected by the 1.9% increase in your tracker margin rate. However, if you arranged your mortgage directly with West Bromwich Building Society (i.e. not via a broker) or before 2006 the chances are that your account number will begin with the number 9 and you are not affected – YET!!! West Brom will give no assurances that mortgages with account numbers beginning with the number 9 will not be affected at some point in the future.

Tracker Rate Class Actions Updates

The reasons we started this campaign are very simple:-

1) We believe the actions of West Brom are immoral

2) We believe the actions of West Brom are unlawful, i.e. they have no legal grounds to increase their tracker rate margins

3) We have no wish to subsidise other areas of the West Bromwich Building Society business model

4) We are fearful of other lenders following suit if West Brom are allowed to get away with this

Mark Smith (Barrister-At-Law) said …

“Representative actions, where one person starts a case representing many others, who all want the answer to a legal question from a court such as ‘is this contract enforceable against me?’ but are not seeking damages. All those who sign up to the action will get the benefit of the win, but they do not have to start their own cases, as they are ‘represented’ by the lead claimant.

The only people who will definitely benefit from success in the case are those who have signed up. There will be no free rides. Any others will have to fight their own corners individually, either alone or with legal help (which will inevitably cost significantly more than the group case).”

If a concerned citizen can communicate with their MP and get them onside before the debate then this will obviously help. We have no idea if/when this debate will take place so it is worth a shot.

However, referring names of MP's without getting them onside is pointless, it's easy to get a list of MP's, getting them on-side is the important part.

I have a telephone conference with David Morris (Tony the hairdressers MP) booked between 1pm and 2pm today by the way. He seems very keen to lead the debate. We had a very quick chat this morning and when I called him he clearly knew who I was without me having to introduce myself so top marks to Tony for facilitating that 🙂

Shoot off rapid and brief e mail - not letter - along lines "WB have recently blah blah (you know the story). This is utterly wrong being a breach of contract for starters. I am not a WB borrower and thus not directly affected BUT I am a Bof I borrower and they have pulled the same stunt.

I am supporting a legal action by WB borrowers to get this reversed not just for their sake but to prevent other lenders jumping on the bandwagon if WB get away with it. As BTL borrowers we are deemed as business/commercial and thus have no regulatory protection from FCA. FOS is disinterested as are the Treasury and Bank of England.

I would welcome your support for a request for a Parliamentary debate being led by xxxxxx xxxxxxMP. May I pass your name to him as being willing to sign the request for said debate? Thanks etc".

Les, see my response just now to "All Bankers are barstewards" on same subject. There is no template letter I know of. Just tailor the suggestions I made to reflect you are a WB borrrower and whack off an e mail pronto. Don't write as it will not be seen or acted upon for longer than an e mail.

I have spoken to David Morris MP and we have provisionally arranged a meeting next week in Westminster for me to brief all of the MP's which have expressed an interest.

The debate has been applied for and the MP's will continue to make application until they get the debate.

A potential fly in the ointment is that a debate cannot be had in the Houses of Parliament if the judiciary are involved in the case. The MP's are aware of this and are, therefore, pressing for the debate as a matter of urgency.

It's all getting very exciting and my marketing brain is coming up with all sorts of angles on how we can use this for PR purposes.

I will let you know when a date/time is confirmed for the meeting and I will obviously update you again soon after 🙂

Assuming a debate goes ahead and its positive for us might the after effect be that Ministers summon the Board of West Brom in ?

This is really exciting news!!

At what juncture in a legal action are the Judiciary deemed to be "involved"? When Justin kicks it off or when date for trial is set, or what?

Even if the debate were not to happen because of this which would be hugely disappointing. there is still good PR to be had along lines "This issue is considered important enough by MP's to merit a HofC debate, Only did not happen because Judiciary were involved" .

The briefing will be about tracker rates generally but will, of course, cover the issues affecting borrowers of both West Brom and the BoI.

I have no idea what will come of it but rest assured I will be milking this for all the PR I can get 🙂
