West Bromwich Building Society Tracker Margins Legal Action

Are you affected by the West Brom Tracker Rate Hike?

If your mortgage account number begins with the number 8 you are highly likely to be one of the unlucky 41% of the mortgage customers of the West Bromwich building Society with a West Bromwich Mortgage Company account affected by the 1.9% increase in your tracker margin rate. However, if you arranged your mortgage directly with West Bromwich Building Society (i.e. not via a broker) or before 2006 the chances are that your account number will begin with the number 9 and you are not affected – YET!!! West Brom will give no assurances that mortgages with account numbers beginning with the number 9 will not be affected at some point in the future.

The reasons we started this campaign are very simple:-

1) We believe the actions of West Brom are immoral

2) We believe the actions of West Brom are unlawful, i.e. they have no legal grounds to increase their tracker rate margins

3) We have no wish to subsidise other areas of the West Bromwich Building Society business model

4) We are fearful of other lenders following suit if West Brom are allowed to get away with this

Mark Smith (Barrister-At-Law) said …

“Representative actions, where one person starts a case representing many others, who all want the answer to a legal question from a court such as ‘is this contract enforceable against me?’ but are not seeking damages. All those who sign up to the action will get the benefit of the win, but they do not have to start their own cases, as they are ‘represented’ by the lead claimant.

The only people who will definitely benefit from success in the case are those who have signed up. There will be no free rides. Any others will have to fight their own corners individually, either alone or with legal help (which will inevitably cost significantly more than the group case).”

Yes what has clearly happened is

1. WB board needed to increase income so employed someone to look into it and get round the fixed margins we were paying

2. They took legal advice to see if they could use clause 5 against a small group and to have someone else to blame if/ when it goes wrong

3. They picked a small enough group that have little public backing and reduced that further to ensure it was not big enough to kick up a fuss and there would be no come backs on the direct advice their associated company gave. Bear in mind they already knew in excess of 12000 BoI borrowers could not do anything

4 . They looked ay Non regulated product to stop the FCA taking an interest , even though the issue is breach of contract , because the FCA are weak.

5 Somehow they decided they were the makers of definition and classed us an Non consumers so we for some strange reason don't have consumer protection ( I really don't understand how they got away with this )

6 They devised one standard letter that fobbed us off so we had to go to the FOS. A totally useless Organisation with little authority . A toothless tiger .

7 Sat back and relied on public apathy knowing no one person would be able to take them to Court and doubted the possibility on what would be a relatively small group of people ( 6700) being able to raise the funds to do so .

Ultimately we will have our time in Court . It really is unlikely they can win this . I just hope that not only will we be refunded and that it stops other lenders from following suit but the people behind this breach are made to pay with their jobs .

They are cheats and cheats should not prosper.

Just had a text from David Morris MP for Morcambe and Lunsdale confrming he has met with Jason McCartney and Steve Baker MP for Wycombe. He informs me that they have applied for a debate.
I asked him what were the timescales and he replied 'the request has gone in and we are waiting for the ballot.'

That's about the size of it Dean. Well put.

Re your para 4/. they probably ran it past the FCA at outset who gave them the green light. Another reason for the FCA doing nothing now.

Re your para 7/. having assumed, wrongly, they would not end up in court WB doubtless dismissed the small print (Latin law) angle even if they knew about it.

Bites in the bottom all round heading their way after the court case.

Like you I would dearly love to see some resignations/sackings etc when this is all over but can you expect disreputable people - today - to suddenly become the reverse ie honourable having been defeated in court? Leopards don't change their spots!

HI Tony, I got the same reply from Jason McCartney regarding applying for a debate. I am very pleasantly surprised at how this is progressing. Jason has also told me he is currently trying to liaise with the list of sympathetic MP's that I sent.

I didn't really expect such a positive result so quickly and would suggest if anyone has the names of other MP's now would be a good time to forward them.
