West Bromwich Building Society Tracker Margins Legal Action

Are you affected by the West Brom Tracker Rate Hike?

If your mortgage account number begins with the number 8 you are highly likely to be one of the unlucky 41% of the mortgage customers of the West Bromwich building Society with a West Bromwich Mortgage Company account affected by the 1.9% increase in your tracker margin rate. However, if you arranged your mortgage directly with West Bromwich Building Society (i.e. not via a broker) or before 2006 the chances are that your account number will begin with the number 9 and you are not affected – YET!!! West Brom will give no assurances that mortgages with account numbers beginning with the number 9 will not be affected at some point in the future.

Tracker Rate Class Actions Updates

The reasons we started this campaign are very simple:-

1) We believe the actions of West Brom are immoral

2) We believe the actions of West Brom are unlawful, i.e. they have no legal grounds to increase their tracker rate margins

3) We have no wish to subsidise other areas of the West Bromwich Building Society business model

4) We are fearful of other lenders following suit if West Brom are allowed to get away with this

Mark Smith (Barrister-At-Law) said …

“Representative actions, where one person starts a case representing many others, who all want the answer to a legal question from a court such as ‘is this contract enforceable against me?’ but are not seeking damages. All those who sign up to the action will get the benefit of the win, but they do not have to start their own cases, as they are ‘represented’ by the lead claimant.

The only people who will definitely benefit from success in the case are those who have signed up. There will be no free rides. Any others will have to fight their own corners individually, either alone or with legal help (which will inevitably cost significantly more than the group case).”

Here here Onslow. To date about five MP's names only have been provided. Frankly I would have hoped 20 plus would have been forthcoming by now because what you have got going is really good. Over last few weeks many forum members have reported being in touch with their MP's so why are they not coughing the names like crazy? That is the only "donkey work" required of them!!!

If your MP agrees to write to the WB Board I'll eat my hat. Let me know when he's done it though and I'll get the salt and pepper out!

Price of the stamp would be better donated to the action fighting fund.

I agree, lets concentrate on more constructive methods.... lets instead get support from MP's... Any MP's sympathetic to the cause let me know and i'll pass them on to Jason McCartney MP, who will try and raise a debate..

My approach is to have this illegal breach of contract overturned. In addition I would like to ensure they no other bank or building society try this on agsin. I've spent days helping to get enough support and funds together to take this to court. I'd like directors from any other organisation to see that the ramifications of trying tips approach can lead to pressure being put on them to resign.

I'm all for having MP s debate this but I'd like there to be some point to it and it result in a positive outcome for this action. Either more people contributing to the fund or some governing authority having a change of policy and taking action against west brom. But in addition id like to see those responsible forced out of their employment to discourage anyone else from tying this on. I'd like to think that those at west brom are made to consider what their outcome maybe if it goes against then in court. Am I really the only one who would like to see these people out of banking employment ?

He wrote to them after earlier correspondance. I got a copy of his reply Thursday. I've written back to him requesting he presses them on some points they didn't answer fully and asked he asks them if they would offer thier resignation should they lose in court.

I thought you were suggesting that he wouldn't write at all to the board ?

Sorry to put a dampener on this but no one in financial services ever really resigns or takes the hit.

Just look at Mr. Dimon, still in charge at JP Morgan after all the billions, yes, you read that right, billions that have been paid in fines to the regulators - The London Whales, Madoff etc... it's all happened and most of the same people are still there at the helm. And the regulators in the US are much tougher than the chocolate teapot kind of regulation we "enjoy" in the UK.

Onslow you can add our MP William Cash to our list of supporters. He is MP for STONE, TRENTHAM, CHEADLE, ECCLESHALL, MADELEY, ASHLEY, GNOSALL, BRADLEY, SALT in STAFFORDSHIRE.
He has been very sympathetic to my wife and myself. He wrote two letters for us to the WBBS and each time he received a reply from Andrew Jones Group Risk Director which was his standard reply to all MP's.
