West Bromwich Building Society Tracker Margins Legal Action

Are you affected by the West Brom Tracker Rate Hike?

If your mortgage account number begins with the number 8 you are highly likely to be one of the unlucky 41% of the mortgage customers of the West Bromwich building Society with a West Bromwich Mortgage Company account affected by the 1.9% increase in your tracker margin rate. However, if you arranged your mortgage directly with West Bromwich Building Society (i.e. not via a broker) or before 2006 the chances are that your account number will begin with the number 9 and you are not affected – YET!!! West Brom will give no assurances that mortgages with account numbers beginning with the number 9 will not be affected at some point in the future.

Tracker Rate Class Actions Updates

The reasons we started this campaign are very simple:-

1) We believe the actions of West Brom are immoral

2) We believe the actions of West Brom are unlawful, i.e. they have no legal grounds to increase their tracker rate margins

3) We have no wish to subsidise other areas of the West Bromwich Building Society business model

4) We are fearful of other lenders following suit if West Brom are allowed to get away with this

Mark Smith (Barrister-At-Law) said …

“Representative actions, where one person starts a case representing many others, who all want the answer to a legal question from a court such as ‘is this contract enforceable against me?’ but are not seeking damages. All those who sign up to the action will get the benefit of the win, but they do not have to start their own cases, as they are ‘represented’ by the lead claimant.

The only people who will definitely benefit from success in the case are those who have signed up. There will be no free rides. Any others will have to fight their own corners individually, either alone or with legal help (which will inevitably cost significantly more than the group case).”

That is a very good and succinct summary of what has happened, Mark. Well done.

Please look out for 17th Jan issue of the Investors Chronicle in which I hope there will be a piece quoting me and Justin re this West Bromwich business.

I have also made the tracker rate issue a key part of my newsletter, just issued, in the last week.

Alison Seabeck and Margaret Hodge MPs are among the MPs we know to have read it, as well as readers from banks, building societies and the Council of Mortgage Lenders.

Just had a very good and in depth chat with David Morris MP for Morecambe and Lunsedale who I know very well. He is extremely sympathetic to our situation. Whilst I was with him he emailed Jason McCartney to propose a meeting between them next week to discuss. He also copied Steve Baker MP for Wycombe into the email.

West Brom replied to my MP in the same way as they seem to have replied to all MP's queries, ie by saying we signed a variable rate mortgage and that the option to raise the rate was clearly in the T&C's. The trick is not to accept this fob off, get back to your MP explain that this is not the case and insist on a face to face meeting to explain the true extent of the problem.

I think MP's are obliged to have this meeting even if it takes time, i waited 4 weeks but i think it was worth it.

Can I suggest people get back to their MP and perhaps get them to at least Email Jason McCartney MP Colne Valley Huddersfield who is sympathetic to our cause.
Who knows where this could lead.

Onslow, you have made the breakthorugh with your MP so we have a potential backbench champion. Really all that is needed now is for all of us to give names of our MP's who have demonstrated any level of support, even if they've done nothing much, to you for passing on to Jason. Then just let him get on with it.

There is no need for us to seek interviews with our MP's now, unless we want to. Let Jason sell the idea to them. He will contact all names we give him saying he is seeking a debate and will they sign a paper supporting his request. Enough names and the game is on. No guarantee but fingers crossed.

No need for us in the forum or elsewhere to do or say any more bar provide MP names.

Hi Onslow,
I've had 2 sympathetic letters from our MP, Pete Wishart, although the second letter enclosed the standard "fob off" reply from Sajid Javid of HM Treasury.
Pete Wishart's parting comment was "If I can be of any further assistance, please let me know", so I will try to arrange a meeting with him.
In the meantime, you might want to add his name to the list of MPs who are at least aware of and sympathise with our complaint.

What about also asking our MPs to get assurances from the board at west brom that if they do lose the case in court they will resign and refund the society from their personal funds for the legal costs. And not take pay offs ?
