West Bromwich Building Society Tracker Margins Legal Action

Are you affected by the West Brom Tracker Rate Hike?

If your mortgage account number begins with the number 8 you are highly likely to be one of the unlucky 41% of the mortgage customers of the West Bromwich building Society with a West Bromwich Mortgage Company account affected by the 1.9% increase in your tracker margin rate. However, if you arranged your mortgage directly with West Bromwich Building Society (i.e. not via a broker) or before 2006 the chances are that your account number will begin with the number 9 and you are not affected – YET!!! West Brom will give no assurances that mortgages with account numbers beginning with the number 9 will not be affected at some point in the future.

Tracker Rate Class Actions Updates

The reasons we started this campaign are very simple:-

1) We believe the actions of West Brom are immoral

2) We believe the actions of West Brom are unlawful, i.e. they have no legal grounds to increase their tracker rate margins

3) We have no wish to subsidise other areas of the West Bromwich Building Society business model

4) We are fearful of other lenders following suit if West Brom are allowed to get away with this

Mark Smith (Barrister-At-Law) said …

“Representative actions, where one person starts a case representing many others, who all want the answer to a legal question from a court such as ‘is this contract enforceable against me?’ but are not seeking damages. All those who sign up to the action will get the benefit of the win, but they do not have to start their own cases, as they are ‘represented’ by the lead claimant.

The only people who will definitely benefit from success in the case are those who have signed up. There will be no free rides. Any others will have to fight their own corners individually, either alone or with legal help (which will inevitably cost significantly more than the group case).”

I've had replies from WB and FCA to queries raised by my MP. All standard stuff but the WB letter in particular has made my day. I laughed out loud and can't wait to see their legal team try to present it in front of a judge. I wonder who'll burst out laughing first - their barrister or the judge! I have forwarded it all to Justin and Mark for more ammo.

I've been out of the loop for a few days with the usual 'time of year' activities but am looking forward to the New Year. I can't imagine doing any of this on my own but with the group we have here it's actually become something to look forward to.

I wish you all a very good Christmas break and roll on 2014!

Anyone looking at this thread will easily see that other people are just a little concerned and nothing more.

I agree with Ian and Richard on the "it's good to talk" approach. Trivial little comments to some can be reassuring words to others and if newbies are reading then I think they would be pleased to see a bit of activity on the forum from concerned and active individuals rather than nothing at all. I for one would miss the constant pinging in my email inbox if there was no activity at all - Merry Christmas everyone! 🙂 Di

indeed - I too would miss 'checking in' and am already beginning to wonder what will I do to fill the hours once WBBS have been sent whimpering back to lick their wounds in their proverbial hole (or shiny new if then impossibly expensive new offices!)?

Hi Folks, Seasons Greetings to you all.

In particular to those who, with a few days off from work, maybe catching up on paper work and with bank statements,

You may have only just realised the letter from West Brom wasn't just a sick joke and yes they have put up your "tracker" rate.

If that's your situation please, feel free to ask any questions. It really does make a difference knowing that others in the same situation have banded together to support each other and are taking a stand. Many of us have been working on this for a while so we should be able to put you on the right path.

Until the additional £297 hit the bank account today, I did still think that maybe it was all just a bad dream. How wrong one can be. Merry Xmas, West Brom.

I'm VERY dissappointed with the Mail on Sunday who carried an article on 29th Dec (page 86) telling us how tracker mortgages can represent such a great deal.

The article mentioned Woolwich, First Direct, HSBC and Santander......but surprisingly they failed to mention how great the West Bromwich tracker mortgages have turned out to be !

Not a word of warning about the dangers of tracker mortgages......

I don't normally buy the Mail or MoS, but managed to obtain a copy this morning (I had to buy a copy of the Daily Sport to hide it inside to avoid embarrassment).

I attempted to post comments on the online edition but this differs from the print edition so I was not successful. I posted on two other tracker stories linking to p118, and found that the October story is still online

Reading the article and then the comments. Seems best to leave it undisturbed. As adds no value as such. Just reignites many peoples perceptions of BTL LL's.
