West Bromwich Building Society Tracker Margins Legal Action

Are you affected by the West Brom Tracker Rate Hike?

If your mortgage account number begins with the number 8 you are highly likely to be one of the unlucky 41% of the mortgage customers of the West Bromwich building Society with a West Bromwich Mortgage Company account affected by the 1.9% increase in your tracker margin rate. However, if you arranged your mortgage directly with West Bromwich Building Society (i.e. not via a broker) or before 2006 the chances are that your account number will begin with the number 9 and you are not affected – YET!!! West Brom will give no assurances that mortgages with account numbers beginning with the number 9 will not be affected at some point in the future.

Tracker Rate Class Actions Updates

The reasons we started this campaign are very simple:-

1) We believe the actions of West Brom are immoral

2) We believe the actions of West Brom are unlawful, i.e. they have no legal grounds to increase their tracker rate margins

3) We have no wish to subsidise other areas of the West Bromwich Building Society business model

4) We are fearful of other lenders following suit if West Brom are allowed to get away with this

Mark Smith (Barrister-At-Law) said …

“Representative actions, where one person starts a case representing many others, who all want the answer to a legal question from a court such as ‘is this contract enforceable against me?’ but are not seeking damages. All those who sign up to the action will get the benefit of the win, but they do not have to start their own cases, as they are ‘represented’ by the lead claimant.

The only people who will definitely benefit from success in the case are those who have signed up. There will be no free rides. Any others will have to fight their own corners individually, either alone or with legal help (which will inevitably cost significantly more than the group case).”

I wouldn't be concerned that the number of posts have reduced - not surprising given the time of the year. I'm sure many will still be reading the comments (not everyone chooses to post all the time:-)). All will pick up again in Jan when the hols are over:-)

Most of us are probably all "posted out" at the moment, as it's been a very busy few months / weeks for most of us getting to grips with all of this, including how best to proceed. Once counsel's opinion is given to us, there will be lots more to consider and debate. At that point, I suspect things will get particularly manic for everybody.

I'm trying my best to follow Vanessa's lead here and spend the next week or two just chilling out. That said, I'm reluctant to switch off completely so will probably keep dipping in and out of here throughout Xmas and New Year as it's quite difficult to let go completely, and I don't have tickets to get myself to Russia for a completely web free break.

Just to reassure you some of us (well at least me) reads all and every comment (and saves them on a file for archive use so we can scan for any given comment easier) and yes I agree the comments have slowed down a touch, but realistically we are waiting on the barristers comments/direction at the moment.

The comments naturally slow down as the arguments formulate and develop and until someone comes up with a "case killer" I would argue the comments become more and more a discussion about the case. I don't think this shows apathy or disinterest, as is born out by the offers to do yet more e-mailing from lots of people.

All of us (and I include you in this ) are still pushing/pulling to keep momentum going.

Christmas is a hopefully a good time for us all and so is a good time to relax a bit and wait.

However (to all ) feel free to comment as usual "its good to talk" lots of us are reading every comment and if the urge takes us will reply.

Have a wonderful Christmas you and to all.

I think that even with our slowed-down rate of posting, we are still outposting our friends on the Bank of Ireland thread. They are only up to 13 so far for December 2013 (to date). I appreciate that they have already had a knock-back, but I sincerely hope that they can also benefit from what we manage to achieve in the coming weeks with WB. Luckily for them, Mark is sufficiently driven as to be willing to move from our successes (hopefully) onto BoI subsequently without drawing breath, and then revisit Skipton too all being well.

If this site were a true reflection of the interest in this case then you can presume almost everyone has lost interest.

That presumption is not true. Therefore, this is just a natural slow down as everyone's attention is temporarily focused on the Christmas period.

Surely it is right that everyone deserves a break and we should not expect the same intensity of posting over the festive season?

To expect the same level of interest right now would be an unfair expectation of ourselves as a group.

The actual or perceived reduction in postings (rather than interest) in the last couple of days seemed entirely consistent to me with a normal weekend respite. I would expect that to continue, in all likelihood, for the next couple of weeks as we all seek to unwind.

Sorry to be a bit of a pain but if I were new to this thread I would find all this introspection a bit off putting. There is a plan in place for the New Year and now is a time for everyone - and I mean everyone - to take a break. I think that if anyone from WBBS were reading all these many e mails about why there are so few e mails they would think that we felt we were on shaky ground and perhaps needed the constant contact. May I respectfully suggest that if there are no new press articles in the next week or so which people want to alert the thread to that we all stop worrying, stop sending e mail about the lack of e mails and the possible reasons for the lack of e mails and the reassuring e mail about the possible reasons for the lack of e mails (this is very Kafkaesque) everyone takes a break. Apart from anything else Mark is going to have to wade through this lot!!! Have a wonderful holiday everyone

Hear Hear! I follow this thread daily to keep in touch and it's a frustrating waste of time when there are posts about trivialities.
