West Bromwich Building Society Tracker Margins Legal Action

Are you affected by the West Brom Tracker Rate Hike?

If your mortgage account number begins with the number 8 you are highly likely to be one of the unlucky 41% of the mortgage customers of the West Bromwich building Society with a West Bromwich Mortgage Company account affected by the 1.9% increase in your tracker margin rate. However, if you arranged your mortgage directly with West Bromwich Building Society (i.e. not via a broker) or before 2006 the chances are that your account number will begin with the number 9 and you are not affected – YET!!! West Brom will give no assurances that mortgages with account numbers beginning with the number 9 will not be affected at some point in the future.

Tracker Rate Class Actions Updates

The reasons we started this campaign are very simple:-

1) We believe the actions of West Brom are immoral

2) We believe the actions of West Brom are unlawful, i.e. they have no legal grounds to increase their tracker rate margins

3) We have no wish to subsidise other areas of the West Bromwich Building Society business model

4) We are fearful of other lenders following suit if West Brom are allowed to get away with this

Mark Smith (Barrister-At-Law) said …

“Representative actions, where one person starts a case representing many others, who all want the answer to a legal question from a court such as ‘is this contract enforceable against me?’ but are not seeking damages. All those who sign up to the action will get the benefit of the win, but they do not have to start their own cases, as they are ‘represented’ by the lead claimant.

The only people who will definitely benefit from success in the case are those who have signed up. There will be no free rides. Any others will have to fight their own corners individually, either alone or with legal help (which will inevitably cost significantly more than the group case).”

Because David, I think, feels that that fact that MPs have supported a move against another lender over their case, demonstrates that in principle there is hope that because of other issues with lenders, that there is hope, more than perhaps we sometimes feel, that we in fact have more chance in our case too. In other words there is light at the end of the tunnel because of this.

Sorry if I'm speaking our of turn here, but while it's fresh on the forum, I noticed your post, and before it gets buried with all the other posts, it just seems pertinent. Correct me if I'm wrong anyone.

Keep up Merv. It demonstrates that, despite what the FCA has been telling us, it can indeed get involved in disputes involving what it might regard as non-consumers. If its remit extends to SMEs, then there should be no reason for its not being able to rule on the unfair and illegal treatment of individuals who just happen to have a few BTL mortgages.

Yes I too was surprised to read that! I can only think he misread it, or was otherwise joking? I'm certain Justin wouldn't want those weighty documents. Ours cost £25.00 to send!
No, I think there is a mistake on that one. It doesn't have any relevance to our case - besides it was only an exercise to cause maximum annoyance to WBBS. At no point did Mark or Justin say it was necessary for them to have.

You posted your response to Denise literally 1 minute after mine, and I have to say you put it far more eloquently than I did. I just knocked it up, hoping it would at least give some value and hope to Norfolk and Chance. However, yours it short and tot he point too, so it makes mine look very ambiguous.
Anyway, thanks for doing a better job than I did in this instance 🙁

I think you are being far too modest, IL. Addressing points like those, speedily as they arise, can only be a good thing for all concerned. In Mark's absence it is incumbent on us all to deal with people's concerns.

I think your point about MPs sitting up and taking notice, essentially once it becomes a vote winner (or loser) is very valid. Our campaign is not yet at that stage with our honourable members, sadly, but I don't think it's far off. Then the FCA will be forced to act.
