West Bromwich Building Society Tracker Margins Legal Action

Are you affected by the West Brom Tracker Rate Hike?

If your mortgage account number begins with the number 8 you are highly likely to be one of the unlucky 41% of the mortgage customers of the West Bromwich building Society with a West Bromwich Mortgage Company account affected by the 1.9% increase in your tracker margin rate. However, if you arranged your mortgage directly with West Bromwich Building Society (i.e. not via a broker) or before 2006 the chances are that your account number will begin with the number 9 and you are not affected – YET!!! West Brom will give no assurances that mortgages with account numbers beginning with the number 9 will not be affected at some point in the future.

Tracker Rate Class Actions Updates

The reasons we started this campaign are very simple:-

1) We believe the actions of West Brom are immoral

2) We believe the actions of West Brom are unlawful, i.e. they have no legal grounds to increase their tracker rate margins

3) We have no wish to subsidise other areas of the West Bromwich Building Society business model

4) We are fearful of other lenders following suit if West Brom are allowed to get away with this

Mark Smith (Barrister-At-Law) said …

“Representative actions, where one person starts a case representing many others, who all want the answer to a legal question from a court such as ‘is this contract enforceable against me?’ but are not seeking damages. All those who sign up to the action will get the benefit of the win, but they do not have to start their own cases, as they are ‘represented’ by the lead claimant.

The only people who will definitely benefit from success in the case are those who have signed up. There will be no free rides. Any others will have to fight their own corners individually, either alone or with legal help (which will inevitably cost significantly more than the group case).”

LEGAL ACTION UPDATE:-

We have been advised we will receive Counsel's opinion in the next day or too so I am afraid I am unable to post anything about it today. Once we receive it, we will need some time to dissect it and then provide an update on the forum.

During the past week a further 13 people have joined our action.

We have also written to clients who have instructed us who had less than 3 properties at the time they took out their mortgage with WBBS. If you have not heard from us and you have instructed us, then you may not have supplied us with the information on the number of properties you owned at the time you took out your mortgage with WBBS, so please let us have this information.

Sorry, but I put wrong link to that story from The Telegraph.

It is not actually yet live as it was in today's paper but no doubt it will come live online very soon.

The title of the piece was: "SME Victims of rate-swap miss-selling may triple to 90,000" in the Business section on page B4.

It is that piece that refers to the 30 MPs .... "More than 30 MPS have backed a call for Mr.Thurso for the existing compensation scheme to be extended to allow customers sold fixed rate loans with embedded swaps to make a claim against their lender"

The WBBS have finally sent ALL the documentation regarding my mortgages... Is this stuff i should be sending to Justin? I have already sent the basic info i had.

Hello all

Today is my last working day before I head off to Russia for Christmas to be with Svetlana’s (my wife’s) family, I will return on 2nd January.

I was hoping to be able to read the QC’s opinion before I go away but he's not finished it yet due to being called into a Court case.There’s not much that can be done over the Christmas period so I’m going to resist the temptation of trying to read it before I go r print it and take it wish me, even if it does arrive before I fly off tomorrow. I know if I do read it I will be chomping at the bit and frustrated about having no internet That's rural Russia for you I'm afraid but it does have plenty of plus points. Therefore I am going to leave it until I return and completely switch off, I need the break!

I have arranged to meet Justin to discuss the QC’s opinion and our strategy in detail on 7th January. It will be an exciting time when we do finally commence litigation against West Brom.

Have a fantastic Christmas and New Years break and I look forward to catching up with you all again on my return.

I haven't read any other posts on this yet, so forgive me if this has already been said (I can't keep up with the forum generally, having to work on other projects), but if Mark Alexander isn't opposed to the idea, I think it'd be best to e-mail him directly, and if it's in any way helpful tot he rest of us, then he can forward it to all those who've registered and have paid up. That way the public wont see or know what this is.
