West Bromwich Building Society Tracker Margins Legal Action

Are you affected by the West Brom Tracker Rate Hike?

If your mortgage account number begins with the number 8 you are highly likely to be one of the unlucky 41% of the mortgage customers of the West Bromwich building Society with a West Bromwich Mortgage Company account affected by the 1.9% increase in your tracker margin rate. However, if you arranged your mortgage directly with West Bromwich Building Society (i.e. not via a broker) or before 2006 the chances are that your account number will begin with the number 9 and you are not affected – YET!!! West Brom will give no assurances that mortgages with account numbers beginning with the number 9 will not be affected at some point in the future.

The reasons we started this campaign are very simple:-

1) We believe the actions of West Brom are immoral

2) We believe the actions of West Brom are unlawful, i.e. they have no legal grounds to increase their tracker rate margins

3) We have no wish to subsidise other areas of the West Bromwich Building Society business model

4) We are fearful of other lenders following suit if West Brom are allowed to get away with this

Mark Smith (Barrister-At-Law) said …

“Representative actions, where one person starts a case representing many others, who all want the answer to a legal question from a court such as ‘is this contract enforceable against me?’ but are not seeking damages. All those who sign up to the action will get the benefit of the win, but they do not have to start their own cases, as they are ‘represented’ by the lead claimant.

The only people who will definitely benefit from success in the case are those who have signed up. There will be no free rides. Any others will have to fight their own corners individually, either alone or with legal help (which will inevitably cost significantly more than the group case).”

You don't have to look very far to see the definition of a Tracker mortgage as follows..............

Tracker index: The base rate or other index to which the tracker rate is linked.

Tracker Rate: A variable rate of interest linked to the tracker index, and as varied from time to time in line with condition 18. The amount of variation will be by the change in the tracker index unless the mortgage offer states a minimum rate of interest at which we will lend or some other modification of this general rule

I'm sure you aren't the only person who has three or more properties who has not been targeted. There are many more of you. As I understand you will fall into one of the following categories:-

1) Your loans were arranged pre 2006 or

2) Your loans were arranged directly with the West Bromwich Building Society as opposed to being arranged via a mortgage intermediary.

In either of these cases it is highly likely that you loan account numbers begin with a 9 and not an 8.

Am I right?

A further key issue is that not only is the "3 BTL mortgages" criterion arbitrary, so too is WB's evidence of who fits that criterion. I have only one BTL mortgage both with and outwith WB, but its response to me (and I am paraphrasing here) is that "we do not believe you" and "prove it!". How can anyone prove what property s/he does not have? WB is just playing games and should it come to court, which I am still not convinced it will, then it stands to be humiliated. If it is, I will laugh all the way to the bank.

I agree with your thoughts.

Also, I think we both agree that it's great to deliberate and swap ideas on this forum, which is part of what this forum is about.

I hope I have encouraged some positive action and thinking with my contributions? and I shall leave this audience to decide the answer to that.

Ultimately though, and maybe sadly, in this case, doubts and unanswered questions can only be settled by a Court.

I'm in a similar situation. My wife and I only have two buy to let's in our joint name. They reckon I have 14 mortgages !! They have not said they don't believe me. They won't even reply. But they took the first increase of the two we have yesterday.

Hi Mark - yes you are right on some of the criteria you have listed. But as i said earlier ... ALL BTL landlords should be supporting this campaign as IF WB get away with this... sure as eggs are omelette-makers all other lenders will try to follow suit.

Yes of course, that's what I have been saying all along. There are 2.5 million people in the UK with tracker mortgages, most of which are completely oblivious to this case and the dangers it poses to their finances. That's why we need the market fund. A huge chunk of what we have achieved has been completed as a result of the commitment of a few dozen people spreading the word far and wide. The reality though is that the more money we raise and the more people we recruit into this campaign the better it will become. I certainly don't fancy having this battle with another half a dozen lenders next year but it is possible. Beating the West Brom in Court will be good but I would also like to raise enough money to fund a judicial review of why the FCA and the other regulators have failed to act on this case and also the BoI, Skipton and Manchester BS cases. Once we can get to that stage then hopefully no lender will dare to try something on like this ever again and if they do, the regulators will know they must deal with it.

Its not where they will get the money to start it from I would be concerned about if I were the contractor .........
