West Bromwich Building Society Tracker Margins Legal Action

Are you affected by the West Brom Tracker Rate Hike?

If your mortgage account number begins with the number 8 you are highly likely to be one of the unlucky 41% of the mortgage customers of the West Bromwich building Society with a West Bromwich Mortgage Company account affected by the 1.9% increase in your tracker margin rate. However, if you arranged your mortgage directly with West Bromwich Building Society (i.e. not via a broker) or before 2006 the chances are that your account number will begin with the number 9 and you are not affected – YET!!! West Brom will give no assurances that mortgages with account numbers beginning with the number 9 will not be affected at some point in the future.

Tracker Rate Class Actions Updates

The reasons we started this campaign are very simple:-

1) We believe the actions of West Brom are immoral

2) We believe the actions of West Brom are unlawful, i.e. they have no legal grounds to increase their tracker rate margins

3) We have no wish to subsidise other areas of the West Bromwich Building Society business model

4) We are fearful of other lenders following suit if West Brom are allowed to get away with this

Mark Smith (Barrister-At-Law) said …

“Representative actions, where one person starts a case representing many others, who all want the answer to a legal question from a court such as ‘is this contract enforceable against me?’ but are not seeking damages. All those who sign up to the action will get the benefit of the win, but they do not have to start their own cases, as they are ‘represented’ by the lead claimant.

The only people who will definitely benefit from success in the case are those who have signed up. There will be no free rides. Any others will have to fight their own corners individually, either alone or with legal help (which will inevitably cost significantly more than the group case).”

Let's not underestimate The Press. I think they are only just getting warmed up.

Wait until January 2014 when the spotlight and media focus intensifies on the court case, at which time I think you are going to see a seismic shift in media attention.

Investment landlords will not get, and should not expect to receive, the immediate press attention but I think that is due to happen soon.

As Annette rightly quotes. Right now this is a "financial/banking” story between a bank and its “commercial” borrowers"

I don't doubt for one minute that the nationals will eventually get involved in a fairly big way, but I suspect that it will be after the event, once we have had our day in court. I do hope I'll be proven wrong though and that they will get stuck in sooner, but the cynic in me says otherwise.

so many folks are christmas stressed right now - in january there will be a lot more staying at home and surfing for entertainment going on when more landlords/investors may come across all your efforts..... well done everyone

We have had this before when a member has inadvertently deleted there member account. Fortunately, when they sign up again using the same email address all comments are re-attached to the member profile as they are linked by email address. I can only surmise that's what has happened here. Pictures and links to social media accounts do not re-appear though and need to be added.

I had exactly the same problem, and was told Justin would eventually get around to it, but never did. Our payment was back in October! I eventually e-mailed Anna at Justin's office and received a prompt reply to say they did indeed have our money and the mortgages we'd lodged were indeed allocated to us. This was our main concern, as although we knew they'd received the cheques, because they'd been cashed, we'd not heard anything, so we couldn't be sure that we'd been correctly allocated and assigned to the specific mortgages we'd lodged.
I know it's a lot of work for Justin and his team, but even so, to not have a courtesy confirmation letter, didn't feel very professional to us - and I'm not saying Justin isn't capable etc., just that it's surely standard practise to acknowledge a customer's letters, especially cheque payments!? Irrespective of whether Justin is doing a good job of representing us, I don't think I'm being unreasonable in expecting something this basic from a lawyer. I think 2 months for a response, and then only after having been chased, is patient by any standard.
