West Bromwich Building Society Tracker Margins Legal Action

Are you affected by the West Brom Tracker Rate Hike?

If your mortgage account number begins with the number 8 you are highly likely to be one of the unlucky 41% of the mortgage customers of the West Bromwich building Society with a West Bromwich Mortgage Company account affected by the 1.9% increase in your tracker margin rate. However, if you arranged your mortgage directly with West Bromwich Building Society (i.e. not via a broker) or before 2006 the chances are that your account number will begin with the number 9 and you are not affected – YET!!! West Brom will give no assurances that mortgages with account numbers beginning with the number 9 will not be affected at some point in the future.

OUR INTENDED CLASS ACTION LITIGATION OVERVIEW

Tracker Rate Class Actions Updates

The reasons we started this campaign are very simple:-

1) We believe the actions of West Brom are immoral

2) We believe the actions of West Brom are unlawful, i.e. they have no legal grounds to increase their tracker rate margins

3) We have no wish to subsidise other areas of the West Bromwich Building Society business model

4) We are fearful of other lenders following suit if West Brom are allowed to get away with this

Mark Smith (Barrister-At-Law) said …

“Representative actions, where one person starts a case representing many others, who all want the answer to a legal question from a court such as ‘is this contract enforceable against me?’ but are not seeking damages. All those who sign up to the action will get the benefit of the win, but they do not have to start their own cases, as they are ‘represented’ by the lead claimant.

The only people who will definitely benefit from success in the case are those who have signed up. There will be no free rides. Any others will have to fight their own corners individually, either alone or with legal help (which will inevitably cost significantly more than the group case).”

LEGAL ACTION UPDATE:

We have had another 19 new instructions this week.

We were expecting the opinion from our QC during the course of this week but unfortunately he had to attend a trial at short notice so was not able to finish it off this week. I have been assured by his clerk that we will get the opinion next week.

I will report back as soon as I hear.

Hello Justin - thanks for updates. As an interested landlord, (with no current WB disputed mortgages - although that could change in the future depending on WB's actions) i have recently made a financial contribution to the 118 campaign as per the bank details at the top of this thread but have had no acknowledgement or further information. Was the contribution to the Property118 marketing fund? If so, Mark Alexander may be able to advise you re: your contribution if it was. If it was made to The Law Department client account, Ana Simpson at The Law Department may be better placed to advise you. If it was made to the client account, I'm sure you will get an acknowledgment in due course. It take a few days though. I've always had any payments I've made to The Law Department client account acknowledged. If you do get in contact with The Law Department and you have contributed to the client account, it may be worth mentioning that you don't have an affected mortgage.

Ultimately, all monies in the client account go towards fighting the WBBS so that can only be a good thing.

The legal action fund is held in The Law Department solicitors client account until fees on behalf of the representative action are billed. Given that you are not affected at the moment you cannot become a client of the law firm for the purpose of this action. I will contact The Law department for you to explain what has happened and ask them to send you a refund.

It still would not prevent WB picking you off, but it would at least show good faith to the court when they take you

By my reckoning that makes a total of 311 instructions @ £240 = £74640 or thereabouts.

Although it almost doesn't matter now as Mark has already told us we will have all the money we'll need for the court action.

I suspect that number may be based upon Justin's figure of 286 loans as at 29 Nov 13 plus the 37 new "instructions" (rather than new "loans") since then.

I'm sure I saw a figure of 500 loans bandied around recently which is well in excess of the 417 target number.

I followed the info to join the class action group including sending the cheque- which has been cashed- some months ago.

Since then I have not received anything from the group.

Advice on how to address this would be greatly appreciated- as far as I can see this forum is my only means of contact?
