West Bromwich Building Society Tracker Margins Legal Action

Are you affected by the West Brom Tracker Rate Hike?

If your mortgage account number begins with the number 8 you are highly likely to be one of the unlucky 41% of the mortgage customers of the West Bromwich building Society with a West Bromwich Mortgage Company account affected by the 1.9% increase in your tracker margin rate. However, if you arranged your mortgage directly with West Bromwich Building Society (i.e. not via a broker) or before 2006 the chances are that your account number will begin with the number 9 and you are not affected – YET!!! West Brom will give no assurances that mortgages with account numbers beginning with the number 9 will not be affected at some point in the future.

Tracker Rate Class Actions Updates

The reasons we started this campaign are very simple:-

1) We believe the actions of West Brom are immoral

2) We believe the actions of West Brom are unlawful, i.e. they have no legal grounds to increase their tracker rate margins

3) We have no wish to subsidise other areas of the West Bromwich Building Society business model

4) We are fearful of other lenders following suit if West Brom are allowed to get away with this

Mark Smith (Barrister-At-Law) said …

“Representative actions, where one person starts a case representing many others, who all want the answer to a legal question from a court such as ‘is this contract enforceable against me?’ but are not seeking damages. All those who sign up to the action will get the benefit of the win, but they do not have to start their own cases, as they are ‘represented’ by the lead claimant.

The only people who will definitely benefit from success in the case are those who have signed up. There will be no free rides. Any others will have to fight their own corners individually, either alone or with legal help (which will inevitably cost significantly more than the group case).”

An update to say I have still not got replies from Sajid Javid (whatever his name is Chief Sec at the Treasury) or Mark Carney to my "your are missing the point" direct letters bypassing the brush off replies received so far via our MP's.

The brush off reply from my MP came yesterday as it happens & is same as everybody else's. "We don't get involved in commercial decisions etc etc". I am using the following analogy in future rants & wish I'd thought of it before.

"You are missing the point as this a breach of contract issue that SHOULD concern you and at least you should speak out as BofE has done re RBS ripping off its commercial customers recently. Burglars don't steal just for the hell of robbing. It is a 'commercial decision' on their part to enrich themselves at the expense of others. Is that not exactly what the WBBS is doing?"

FOS - I submitted my file to them prior to becoming aware off this site and my case appears to have passed the initial hurdles. I have also sent them proposed letters from counsel as provided by Justin Selig.
Is it possible to establish who is furthest down the line with the FOS?
The first case to go through may set some kind of precedent for the rest of the cases as and when they are submitted and we may be able to form our best tact.

And "landlords with multiple properties" goes back to my original point many weeks ago, with regards to discrimination. Surely they've not ONLY acted unlawfully with regards to breaking the contract terms, but are also actively discriminating! Surely this alone is unlawful; but when added to the breach of contract too, must add significant weight to our case?

I noticed your post and would be grateful if you could clarify what letters from Counsel you are referring to. Are you talking about the covering template available on this website, or has Justin sent you something under separate cover.
I have already lodged my case with the FOS, but want to ensure that I have given them all the relevant information if there is any additional letters.

Alan - I am referring to Justin's update of the 22/11/13 approx 15.00.
Has your case been placed with an adjudicator yet? If so they should call you to discuss. There is then an opportunity to add any additional pieces of information to your case which you feel relevant. That said, as you may well know, you can send in additional info at any time during the process.

I did see this post on the 22nd, but had already submitted my documents to the FOS at that time. At present, all I have received back is an acknowledgment letter, no adjudicator has been appointed as yet.
I am under the impression from the post on the 22nd that Justin is holding back any further letters being sent out regarding the Ombudsmen till he has received a response from the QC, which is expected any day now. If this is any different, I would be grateful if someone would let me know.

Akan, you are right that Justin will be telling us all what to do re contacting the FOS in due course, shortly I guess. His advice will include template letter etc. Therefore relax on this issue meanwhile.
