West Bromwich Building Society Tracker Margins Legal Action

Are you affected by the West Brom Tracker Rate Hike?

If your mortgage account number begins with the number 8 you are highly likely to be one of the unlucky 41% of the mortgage customers of the West Bromwich building Society with a West Bromwich Mortgage Company account affected by the 1.9% increase in your tracker margin rate. However, if you arranged your mortgage directly with West Bromwich Building Society (i.e. not via a broker) or before 2006 the chances are that your account number will begin with the number 9 and you are not affected – YET!!! West Brom will give no assurances that mortgages with account numbers beginning with the number 9 will not be affected at some point in the future.

Tracker Rate Class Actions Updates

The reasons we started this campaign are very simple:-

1) We believe the actions of West Brom are immoral

2) We believe the actions of West Brom are unlawful, i.e. they have no legal grounds to increase their tracker rate margins

3) We have no wish to subsidise other areas of the West Bromwich Building Society business model

4) We are fearful of other lenders following suit if West Brom are allowed to get away with this

Mark Smith (Barrister-At-Law) said …

“Representative actions, where one person starts a case representing many others, who all want the answer to a legal question from a court such as ‘is this contract enforceable against me?’ but are not seeking damages. All those who sign up to the action will get the benefit of the win, but they do not have to start their own cases, as they are ‘represented’ by the lead claimant.

The only people who will definitely benefit from success in the case are those who have signed up. There will be no free rides. Any others will have to fight their own corners individually, either alone or with legal help (which will inevitably cost significantly more than the group case).”

The NLA reps are perfectly entitled to express their personal views though in much the same way as Mary Latham does, providing of course they do not cause embarrassement to their employers. Mary manages this, I can't see any reason why others can't 🙂

Hi Jamie

We have all received the veiled threats of loans being called in with 28 days notice. Consensus is the risk is small but there is a risk. However, that has not prevented over 500 people paying into the campaign fund to be represented in the legal action.

No. They have not asked me to pay anymore or request the info again, they have just agreed to release the information to me. If others do not request this information I doubt that they will be sent it as their report will have to be broken down to provide individuals results, so it will be a lengthy process. I would just send a letter saying this information was omitted from your SARS Pack to be sure of receipt.

I think you are absolutely right. I feel exactly the same way, as sometimes one needs to read carefully and in detail to understand the central point of this campaign, when reported in the media.

I tend to think that people want easy-to-read information and 'sound bytes' as the cliche goes, as most people are busy (watching TV and on the Internet as well as general chores), and psychologically, they just switch off if anything more demanding than a headline is placed before them. That's not to suggest they are stupid, but just that many/most people just aren't interested in things like this, about mortgages - especially if they're not directly affected (yet!).

So sure, let's keep it snappy and to the point. Maybe the journalists can take cues from us, if we inform THEM in a punchy style to begin with (not that sometimes we don't, but we need maybe to focus on keeping it simpler for public consumption).

Thanks to everyone for all their ongoing efforts, and my apologies for not having contribute much for a while. I am trying to catch up a bit now though.

Tomorrow being Friday the 13th, I was hoping to encourage a further sense of solidarity as a group and send a firm signal to West Brom, that this is an ongoing, concerted and relentless effort until the deadline in January 2014, approximately 3 weeks away!

RECOMMENDED NEW E-MAIL TEMPLATE TO SEND TO MORTGAGE ADVISERS

Hi

I found your details via Yell.com, I’m not a client of yours … YET.

My mortgage advisers sold me a tracker mortgage with the West Brom Mortgage Company a few years ago. This month the West Brom have put the interest rate up, even though the tracker is for life!

Needless to say I may be looking for another mortgage adviser at some point, could you help with this?

I am not alone either, there are another 6,700 of us and we have formed a campaign group via an internet forum called Property118.com

We have managed to raise a huge amount of money to take the West Brom to Court so fundraising is no longer our number one priority, however, we do want to raise awareness of the campaign and this very important issue amongst brokers and people with tracker rate mortgages who could also be affected.
