West Bromwich Building Society Tracker Margins Legal Action

Are you affected by the West Brom Tracker Rate Hike?

If your mortgage account number begins with the number 8 you are highly likely to be one of the unlucky 41% of the mortgage customers of the West Bromwich building Society with a West Bromwich Mortgage Company account affected by the 1.9% increase in your tracker margin rate. However, if you arranged your mortgage directly with West Bromwich Building Society (i.e. not via a broker) or before 2006 the chances are that your account number will begin with the number 9 and you are not affected – YET!!! West Brom will give no assurances that mortgages with account numbers beginning with the number 9 will not be affected at some point in the future.

Tracker Rate Class Actions Updates

The reasons we started this campaign are very simple:-

1) We believe the actions of West Brom are immoral

2) We believe the actions of West Brom are unlawful, i.e. they have no legal grounds to increase their tracker rate margins

3) We have no wish to subsidise other areas of the West Bromwich Building Society business model

4) We are fearful of other lenders following suit if West Brom are allowed to get away with this

Mark Smith (Barrister-At-Law) said …

“Representative actions, where one person starts a case representing many others, who all want the answer to a legal question from a court such as ‘is this contract enforceable against me?’ but are not seeking damages. All those who sign up to the action will get the benefit of the win, but they do not have to start their own cases, as they are ‘represented’ by the lead claimant.

The only people who will definitely benefit from success in the case are those who have signed up. There will be no free rides. Any others will have to fight their own corners individually, either alone or with legal help (which will inevitably cost significantly more than the group case).”

I really hope we do have one or more West Brom BS spies in the camp. If we do I have the following message for them .......

If you think you can call in a mortgage and enforce that through the Courts then try it on me. My mortgage account number with you is 800823623, It is standard warfare tactics to take out the Generals so come on, give it a try! Your letters will not frighten me, a Court summons will not frighten me, the PR will help me. So come on West Brom BS, shall we dance?

I'd have a better chance of getting possession after serving a section 8 notice on a model tenant LOL

Do you think it should be on a donate what you want basis or a fixed amount and if so how much?

Great idea. I want to know how they can charge me £1500 arrangement fee for this tracker then have the cheek to change it so that it is no longer a tracker. Furthermore I am given to understand that this increased rate is for multiple house owners so what happens when a single house owner who is now included in the increased mortgages debacle buys another property after December does he become liable for the higher rate? and what right do they have to come by this private information?
I couldn't sleep last night thinking of the injustice of all this. I am simply trying to prepare for my old age - why am I bothering?

thank you once again for organising all this. Can't have been easy fielding some of the questions thrown at you. Hope you managed to get away from your computer for a walk or a drink etc.

I'm getting all my paperwork together along with the £240 cheque.

I had free legals, from solicitors in Glasgow. It was made clear that the conveyancers were only acting for WB. If I wanted further advice, I'd have to go and find it myself. No T&C booklet provided but the 'Offer of Loan - Standard Conditions of Offer Scotland' did have the following paragraph:

'12.8 The Company reserves the right to withdraw or amend this offer of loan at any time in exceptional circumstances, such as fraud, or due to circumstances beyond the control of the Company.'

Making a bad financial decision by offering long-term trackers tied closely to the base rate is not a circumstance beyond the control of the Company. They created this circumstance themselves! They were the ones who made the decision about offering such a loan. Myself and many others simply accepted the offer they had made. The only example of fraud seems to be the one that WB are trying on now.

To re-enforce your comments, my wife also suggested that it may be a WBBS employee on the forum , so here is one of my account nos 800650458 that way they can choose whom they wish to vilify in any court action. As you say the publicity will do us some good, and I'm sure Justin would enjoy the extra work LOL

I'm sure that the WBBS ran through the various outcomes prior to making an announcement. So nothing posted here would be of great interest. More likely they are already looking at further ways of improving the solvency of the BS.
