West Bromwich Building Society Tracker Margins Legal Action

Are you affected by the West Brom Tracker Rate Hike?

If your mortgage account number begins with the number 8 you are highly likely to be one of the unlucky 41% of the mortgage customers of the West Bromwich building Society with a West Bromwich Mortgage Company account affected by the 1.9% increase in your tracker margin rate. However, if you arranged your mortgage directly with West Bromwich Building Society (i.e. not via a broker) or before 2006 the chances are that your account number will begin with the number 9 and you are not affected – YET!!! West Brom will give no assurances that mortgages with account numbers beginning with the number 9 will not be affected at some point in the future.

OUR INTENDED CLASS ACTION LITIGATION OVERVIEW

Tracker Rate Class Actions Updates

The reasons we started this campaign are very simple:-

1) We believe the actions of West Brom are immoral

2) We believe the actions of West Brom are unlawful, i.e. they have no legal grounds to increase their tracker rate margins

3) We have no wish to subsidise other areas of the West Bromwich Building Society business model

4) We are fearful of other lenders following suit if West Brom are allowed to get away with this

Mark Smith (Barrister-At-Law) said …

“Representative actions, where one person starts a case representing many others, who all want the answer to a legal question from a court such as ‘is this contract enforceable against me?’ but are not seeking damages. All those who sign up to the action will get the benefit of the win, but they do not have to start their own cases, as they are ‘represented’ by the lead claimant.

The only people who will definitely benefit from success in the case are those who have signed up. There will be no free rides. Any others will have to fight their own corners individually, either alone or with legal help (which will inevitably cost significantly more than the group case).”

That's 34 Mortgage Brokers in Glasgow emailed about Property 118
Will start on Edinburgh and other cities tomorrow.

It's great to be able to have a positive input in this campaign.

Let's all keep up the good work and make sure that most of the affected Tracker customers get to hear of the forum before Christmas.

Seems to me that any checks carried out were unlikely to have identified foreign property or mortgages held with foreign banks. So, anyone with a few furnished holiday lets overseas may then escape their checks.

My business partner, Neil Patterson, is an expert in Data Protection having previously been a compliance officer. This has got him confused as he believes West Brom will have all the permissions they need to run credit checks which don't leave credit footprints whenever they like.

Could it be a curveball thrown in to confuse us perhaps?

We should press the issue to see what comes of it but I can't see it affects the legal case.

You are right.

Borrowers would have signed a Data Protection disclaimer giving West Brom rights to undertake such activities. You saw mention of the phrase to "maintain your account".

Therefore West Brom can use the disclaimer to undertake searches to do what they perceive as "Maintain an account".

Great! Thanks for your effort.

You're right- you have to drill down into the websites to get the email addresses and that's the time consuming part.

I'm waiting for Mark to respond in several days or so to let us know if he thinks our efforts paid off.

Sure, this is how to do it and I'll put the template in the next post in a minute.........

Please go to http://www.yell.com and search “Mortgage Brokers” in your area such as “Essex” or “East Sussex”

Once you’ve done the Yell search you can then see links to the Mortgage Advisers websites. So just have a simple letter regarding spreading the word about this cause ready to copy and past to them.

All you have to do is 10 emails and email Mark Alexander to let him know you have done it.

Mark can then see the difference it makes and feed back to to those who participated and to this forum generally……………..

Just a 100 people doing this will produce 1000 emails across the country!

You might be aware of the current Class Legal Action at http://www.Property118.com which is mounting against the recent mortgage rate hike imposed by West Bromwich Building Society.

If your client's Buy to Let mortgage account number begins with the number 8 they are highly likely to be one of the unlucky 41% of the mortgage customers of the West Bromwich Building Society with a West Bromwich Mortgage Company account affected by the 1.9% increase in their tracker margin rate.

This letter is not wholly about the need to raise further funding as Property118 has already raised over £100,000, which is enough to fight this case.

Class Action Legal papers will be served on West Bromwich in January 2014 and as a result Property 118 are calling on brokers to inform their clients with mortgage account numbers starting with the number 8.

Please will you help spread the word about the legal action to your clients who may wish to contribute the legal fund arranged by Property118 and Solicitor Justin Selig?

Some of the affected borrowers are solicitors and mortgage advisers like yourself.
