West Bromwich Building Society Tracker Margins Legal Action

Are you affected by the West Brom Tracker Rate Hike?

If your mortgage account number begins with the number 8 you are highly likely to be one of the unlucky 41% of the mortgage customers of the West Bromwich building Society with a West Bromwich Mortgage Company account affected by the 1.9% increase in your tracker margin rate. However, if you arranged your mortgage directly with West Bromwich Building Society (i.e. not via a broker) or before 2006 the chances are that your account number will begin with the number 9 and you are not affected – YET!!! West Brom will give no assurances that mortgages with account numbers beginning with the number 9 will not be affected at some point in the future.

Tracker Rate Class Actions Updates

The reasons we started this campaign are very simple:-

1) We believe the actions of West Brom are immoral

2) We believe the actions of West Brom are unlawful, i.e. they have no legal grounds to increase their tracker rate margins

3) We have no wish to subsidise other areas of the West Bromwich Building Society business model

4) We are fearful of other lenders following suit if West Brom are allowed to get away with this

Mark Smith (Barrister-At-Law) said …

“Representative actions, where one person starts a case representing many others, who all want the answer to a legal question from a court such as ‘is this contract enforceable against me?’ but are not seeking damages. All those who sign up to the action will get the benefit of the win, but they do not have to start their own cases, as they are ‘represented’ by the lead claimant.

The only people who will definitely benefit from success in the case are those who have signed up. There will be no free rides. Any others will have to fight their own corners individually, either alone or with legal help (which will inevitably cost significantly more than the group case).”

We will NOT settle on any basis.

Similar to the Seasoned Female Investor I have been following the campaign from the beginning and joined the class action and paid the £240 to Justin as soon as the details were available.
I have only one mortgage affected with WestBrom but have 2 more with another building society so would really like to get this sorted once and for all, rather than have to return for another fight in 6 months time.
It is extremely heartening to see the excellent work being carried out and advice we have been given to help out. I have already sent letters and all the other 'to do' list items.
It's great to be proactive and also embrace the camaraderie among those placing comments. The legal knowledge and financial expertise of those on the forum is excellent and the tireless energy of Mark to keep us on the right track will soon be rewarded!

Thanks Richard Kent for the encouragement for us to come forward.I have just emailed 20 mortgage brokers in Glasgow and when I've taken a break to watch my Monday evening soaps! I will return to complete the rest in Glasgow and may even venture towards Edinburgh and other major Scottish cities.
Once you have the template and email set up it doesn't take long to add the email addresses of the brokers from their imdividual websites.So thanks again for motivating me and possibly many others working away in the background.

By the way a group meeting in London or other major city, possibly after a positive result in January would be well worth it.
Keep up the good work and to our future success!

I am not an expert on data protection, but what WBBS may have done here does sound decidedly odd.... I would be interested to see what an expert in data protection / someone who has some expertise in what is an acceptable roles for the credit ref agencies / data searches might say about this kind of activity.
May be worth googling to find an expert with a worthwhile opinion on this.

The whole exercise, if it was ever attempted at all, must be some attempt to work out who is a "pro" (muutiple) landlord vs who was could be viewed as a "consumer"... Of course, this separation, as a distinction, has never been established anyway - only alluded to in the Foxtons case of repeat letting fees in Lord Justice Mann's judgement.

However, the whole exercise, if it was ever performed by the lender, seems irrelevant anyway because this whole case is around trying to pass off terms hidden in a separate mortgage document to somehow overrule all the other key information which all made it clear that these were tracker rates GUARANTEED TO TRACK ABOVE THE BOE BASE RATE.

I cannot see this argument working for the lender - and their use of credit data, if indeed that was what was attempted, does seem a little questionable.

Do you mean the ICO. Yes they are helpful. WBBS were seeking information from them to ascertain if they were required to pass on the information, they obviously now have their answer. I do not wish to say any more at this stage as we know the spies are reading our comments.
