West Bromwich Building Society Tracker Margins Legal Action

Are you affected by the West Brom Tracker Rate Hike?

If your mortgage account number begins with the number 8 you are highly likely to be one of the unlucky 41% of the mortgage customers of the West Bromwich building Society with a West Bromwich Mortgage Company account affected by the 1.9% increase in your tracker margin rate. However, if you arranged your mortgage directly with West Bromwich Building Society (i.e. not via a broker) or before 2006 the chances are that your account number will begin with the number 9 and you are not affected – YET!!! West Brom will give no assurances that mortgages with account numbers beginning with the number 9 will not be affected at some point in the future.

Tracker Rate Class Actions Updates

The reasons we started this campaign are very simple:-

1) We believe the actions of West Brom are immoral

2) We believe the actions of West Brom are unlawful, i.e. they have no legal grounds to increase their tracker rate margins

3) We have no wish to subsidise other areas of the West Bromwich Building Society business model

4) We are fearful of other lenders following suit if West Brom are allowed to get away with this

Mark Smith (Barrister-At-Law) said …

“Representative actions, where one person starts a case representing many others, who all want the answer to a legal question from a court such as ‘is this contract enforceable against me?’ but are not seeking damages. All those who sign up to the action will get the benefit of the win, but they do not have to start their own cases, as they are ‘represented’ by the lead claimant.

The only people who will definitely benefit from success in the case are those who have signed up. There will be no free rides. Any others will have to fight their own corners individually, either alone or with legal help (which will inevitably cost significantly more than the group case).”

They have withheld any information regarding their latest searches, when I asked how they thought I had x mortgages I was told that they were consulting with the ICO as to whether they were required to give us this information.

In following up that today I was told.

I can confirm that we are reviewing information received from the Information Commissioner’s Office, along with our agreement with the Credit Reference Agency (CRA), to ascertain whether we are obliged to release the data used in connection with our decision to increase the rate on your Buy to Let mortgage.

So we wait!

Dean/Mark, I always suspected that we would get a wave of new recruits when the increased payments kicked in. I wouldn't be at all surprised if this is exactly what we're seeing here. Plus the results of all the hard work from everyone here, of course!

Feels to me that West Brom have just released information that they know is benign in terms of our court case. Makes the whole process of a data protection request pretty worthless if companies are able to pick and choose the information they give you:-)

I suspect they are Richard, keep up the good work. There may be others following your excellent lead who are too shy to engage on the forum. Generally our stats are approximately 1,000 readers to every commenter who engages via the forum. We must never under-estimate the power of what we post and the influence this has on those who read all and say nothing.

I agree and surely the whole point of a SAR is that we get every piece of info that a company holds on you. Not what they pick and choose to send.

If they are indeed consulting with who they have told you Rosemary it will be interesting to see what happens.

That sounds encouraging.

So to anyone reading this.

Please go to http://www.yell.com and search "Mortgage Brokers" in your area such as "Essex" or "East Sussex"

Once you've done the Yell search you can then see links to the Mortgage Advisers websites. So just have a simple letter regarding spreading the word about this cause ready to copy and past to them.

All you have to do is 10 emails and email Mark Alexander to let him know you have done it.

Mark can then see the difference it makes and feed back to to those who participated and to this forum generally.................

Just a 100 people doing this will produce 1000 emails across the country!

I agree that it could be an overprovision. These half-year figures are not audited. I too wondered if this very round £10.0 million (to one decimal place!) was overstated to make their finances look worse, in order to justify their levy on us. (Not to reduce taxable profit - WB has made losses for the last five years.)

So, WB has increased its half-year loss by £10.0 million, either because of real impairments or because it is trying to mislead outsiders. Which of these alternatives makes WB look good?

Thats an interesting analogy however, its worth noting that there was no lasting damage to Ford who recovered quickly and have arguably been the strongest performer of the big three (Ford, Chrysler, GM).
