West Bromwich Building Society Tracker Margins Legal Action

Are you affected by the West Brom Tracker Rate Hike?

If your mortgage account number begins with the number 8 you are highly likely to be one of the unlucky 41% of the mortgage customers of the West Bromwich building Society with a West Bromwich Mortgage Company account affected by the 1.9% increase in your tracker margin rate. However, if you arranged your mortgage directly with West Bromwich Building Society (i.e. not via a broker) or before 2006 the chances are that your account number will begin with the number 9 and you are not affected – YET!!! West Brom will give no assurances that mortgages with account numbers beginning with the number 9 will not be affected at some point in the future.

OUR INTENDED CLASS ACTION LITIGATION OVERVIEW

Tracker Rate Class Actions Updates

The reasons we started this campaign are very simple:-

1) We believe the actions of West Brom are immoral

2) We believe the actions of West Brom are unlawful, i.e. they have no legal grounds to increase their tracker rate margins

3) We have no wish to subsidise other areas of the West Bromwich Building Society business model

4) We are fearful of other lenders following suit if West Brom are allowed to get away with this

Mark Smith (Barrister-At-Law) said …

“Representative actions, where one person starts a case representing many others, who all want the answer to a legal question from a court such as ‘is this contract enforceable against me?’ but are not seeking damages. All those who sign up to the action will get the benefit of the win, but they do not have to start their own cases, as they are ‘represented’ by the lead claimant.

The only people who will definitely benefit from success in the case are those who have signed up. There will be no free rides. Any others will have to fight their own corners individually, either alone or with legal help (which will inevitably cost significantly more than the group case).”

I don't wish to get too high brow but men died in WW2 and since fighting against countries who chose to ignore the Geneva Convention, firmly believing they also paid the supreme sacrifice to uphold proper values at home. These include sticking by agreements/contracts made which our wartime enemies did not do. The WB issue is small beer in the big scheme of things but symptomatic of a disgraceful fall in values.

Further to your point.

The West Brom financial information quotes

"Interest receivable, however, remains constrained by the low returns
on high quality treasury assets, held for liquidity purposes, and the
substantial proportion of mortgage loans linked to Bank Rate"

This might indicate WBBS want to repeat their hike in future should the Base Rate remain low.

I pointed landlords to this discussion and the Class Action when I spoke at the Landlords Show in Coventry a few days ago. Several of landlords asked me to repeat the site address and some of them wanted to talk about it after my talk but I told them that I did not know the facts and that they should join this discussion or at least read it and join the fight.

I will continue to point landlords to this discussion because there seem to be many, many of them affected who have no idea what to do.

In answer to your questions ....

1) In the early days we needed gorilla warfare marketing tactics as we had no money and no support. However, it was always inevitable that West Brom would start monitoring this thread as popularity and funds began to grow. We now have several allies and all the funding we need. We share what our members need to know in full knowledge that West Brom execs and their advisers are reading this forum. Our gorilla tactics have not been dropped though. We have intentionally sent them on several wild goose chases 😉
2) Good question, it's one of ours too
3) It is our opinion that condition 5 which WBBS are so reliant upon bears no relevance to tracker mortgages. We have significant evidence to support this.
4) If you read the full booklet it is very obvious that it is generic to their product range. For example, look at the conditions about letting and high advance fees, neither of which are applicable to these mortgages. Also note condition 1 bullet point six, then look up the definition of "contra proferentem" via a Google search to understand why condition 5 should be struck out by a judge.
5) You example isn't exactly politically correct but I agree with the point you are making
6) Treating Customers fairly is one of the business principles of the FCA, interestingly the basis upon which several financial institutions have been fined and many of which have not been consumer related but commercial deals, e.g. IRHP's. Other FCA business principles West Brom are breaching include financial promotions needing to be "clear, fair and not unreasonable"

Your member profile says you are based in Pbro but your email address is NZ based. Please explain as I can't find details online of an Ian Ness in Pbro other than obituaries.

I don't believe there is any evidence that confirms the West Brom has approached the FCA for "external validation". It's probably not even advice from a lawyer. It's more than likely just Andrew Jones getting a little too carried away with the exuberance of his own verbosity in attempting to mask the West Brom's actions with a thin veneer of supposed legitimacy.

Hello Mark,

I thought we were not quite there yet in terms of funding (albeit close to being fully funded) for the class action / ATE insurance. Your reply to Ian Ness suggests that we now have all the funds that we need. Is this the case?

I am a paid up member of this class action and I am guessing that we will receive direct emails from yourself/Justin regarding updates that we do not want to post on the forum. Is this the case as of yet I have not received any updates by email regarding funding etc.

Finally, I just want to thank you for all of the effort you are putting into this. I am very heartened by the positive comments I have been reading on this site over the past few weeks. The feeling seems to be that we have a very strong case. Do you think WBBS will actually let this go all the way to court?
