West Bromwich Building Society Tracker Margins Legal Action

Are you affected by the West Brom Tracker Rate Hike?

If your mortgage account number begins with the number 8 you are highly likely to be one of the unlucky 41% of the mortgage customers of the West Bromwich building Society with a West Bromwich Mortgage Company account affected by the 1.9% increase in your tracker margin rate. However, if you arranged your mortgage directly with West Bromwich Building Society (i.e. not via a broker) or before 2006 the chances are that your account number will begin with the number 9 and you are not affected – YET!!! West Brom will give no assurances that mortgages with account numbers beginning with the number 9 will not be affected at some point in the future.

Tracker Rate Class Actions Updates

The reasons we started this campaign are very simple:-

1) We believe the actions of West Brom are immoral

2) We believe the actions of West Brom are unlawful, i.e. they have no legal grounds to increase their tracker rate margins

3) We have no wish to subsidise other areas of the West Bromwich Building Society business model

4) We are fearful of other lenders following suit if West Brom are allowed to get away with this

Mark Smith (Barrister-At-Law) said …

“Representative actions, where one person starts a case representing many others, who all want the answer to a legal question from a court such as ‘is this contract enforceable against me?’ but are not seeking damages. All those who sign up to the action will get the benefit of the win, but they do not have to start their own cases, as they are ‘represented’ by the lead claimant.

The only people who will definitely benefit from success in the case are those who have signed up. There will be no free rides. Any others will have to fight their own corners individually, either alone or with legal help (which will inevitably cost significantly more than the group case).”

I think its emotional propaganda aimed at my MP who I believe has completely missed the point and thinks that the letter from Mr Jones has adequately addressed all of my concerns regarding the rate increase and the credit checks that were carried out on us.

Interesting to read the snippet of the letter from the WBBS that Nicola has posted. They really do seem to be running round like headless chickens. What an unbelievable comment for a person to make in such a senior position. The WBBS offered base rate tracker products tracking the BOE base rate, what on earth did he expect would happen if the BOE rate reduced, maybe they should have heeded their own warning about what happens to the cost of repayments when the base rate goes up or down. If the risk manager doesn't understand how his own product works how on earth can he hold such a position.
The further this goes on the more incompetence is revealed, I can't wait to read about all this when it hits the media in the aftermath of them losing in court.

but the Statue of Liberty photo came out so large that it needed most of a new page and so the bottom of two-thirds of page 1 is blank.

Also the text seems to dive straight into detail about account numbers and WB sub companies. Can you edit the first long sentence into 2 with the first starting something like "As you will probably know, the WBBS has recently hiked the tracker margin for 6,700 BTL customers despite their marketing material and offer letters stating ...

I think the reason given by Andrew jones from wbbs is very valid. I'm sure when wb use this in court it will be a major argument against our case.

When the judge hears this I can see him finding against us . Looks like we are stuffed With this well thought out answer. Oh well we tried !!

Just a little light sarcasm on the part of Dean. It's quite apparent that Andrew Jones is utterly clueless about the crux of our case. All his bleating about elderly savers or the poor widows and orphans if the rate hike isn't implemented (Oh won't somebody please think of the children!) is not an argument that the West Brom can run at court. If they did try to run it, it would be given short shrift as there is a long line of case law that affirms that a party cannot wriggle out of a contract simply because it is has become uneconomic or even severely uneconomic for that party to abide by the terms of the contract. It doesn't matter if the world is going into financial meltdown or if the credit markets have frozen solid. If the contract is still capable of being performed, then arguments based on the economics of the contract won't be entertained.

The West Brom failed to do their due diligence and they made a bad bargain. Bad for them. Good for us. The West Brom made a bet. They lost the bet. We won the bet. It's that simple. It's a zero sum game. Now the West Brom are spitting their dummy out of the pram and crying about it.

Cry me a river.
