West Bromwich Building Society Tracker Margins Legal Action

Are you affected by the West Brom Tracker Rate Hike?

If your mortgage account number begins with the number 8 you are highly likely to be one of the unlucky 41% of the mortgage customers of the West Bromwich building Society with a West Bromwich Mortgage Company account affected by the 1.9% increase in your tracker margin rate. However, if you arranged your mortgage directly with West Bromwich Building Society (i.e. not via a broker) or before 2006 the chances are that your account number will begin with the number 9 and you are not affected – YET!!! West Brom will give no assurances that mortgages with account numbers beginning with the number 9 will not be affected at some point in the future.

The reasons we started this campaign are very simple:-

1) We believe the actions of West Brom are immoral

2) We believe the actions of West Brom are unlawful, i.e. they have no legal grounds to increase their tracker rate margins

3) We have no wish to subsidise other areas of the West Bromwich Building Society business model

4) We are fearful of other lenders following suit if West Brom are allowed to get away with this

Mark Smith (Barrister-At-Law) said …

“Representative actions, where one person starts a case representing many others, who all want the answer to a legal question from a court such as ‘is this contract enforceable against me?’ but are not seeking damages. All those who sign up to the action will get the benefit of the win, but they do not have to start their own cases, as they are ‘represented’ by the lead claimant.

The only people who will definitely benefit from success in the case are those who have signed up. There will be no free rides. Any others will have to fight their own corners individually, either alone or with legal help (which will inevitably cost significantly more than the group case).”

Please note that I was the MD of The Money Centre who sold 100's of these mortgages, I even purchased one myself!

The Property118 website is a retirement hobby and operates on a not for profit basis. It is the Property118 forum which is running the Class Action Campaign against West Brom.

I do not benefit from this financially, save for potentially avoiding the 1.9% hike on my tracker mortgage margin. Barristers are not allowed to pay commission and even if they did all the money they paid would go back into Property118 for the benefit of it's members.

If Property118 was not running this campaign the borrowers affected by the West Brom rate hike would be running around like headless chickens. They would be looking to blame whoever they could. By coordinating this campaign I am able to direct them towards fighting the true villains here, i.e. West Brom. The result of this is that brokers have been spared the complaints to their regulators, networks of the FOS.

In the unlikely event of the Class Action group failing to prove that West Brom are illegally increasing their rates these affected borrowers will still be looking for somebody to blame. It will then be brokers and solicitors in the firing line and I will not be able to stop that.

I placed one message on the Solicitors and Barristers forum to prove the point and within days I had a queue of direct access barristers offering to take on the professional negligence cases against brokers on a "no win no fee" basis if the Class Action against West Brom fails. If I hadn't done this do you really think that none of the 6,699 other affected borrowers would have thought of it?

The threat to brokers is very clearly established but to my knowledge nobody will be pursuing this angle until the outcome of the Court case against West Brom is established. Whether you like my style or not is irrelevent, the message is simple. If brokers do not help the clients they recommended the West Brom tracker rate products to they could very easily find themselves in the firing line at some point.

It is time to pick a side and I very much hope you will encourage all brokers to back the Class Action group.

As for my own mortgage, I will not be suing myself and I don't fancy dealing with hundreds of complaints form affected borrowers either, hence I feel I'm backing the right side.

You could, of course, just bury your head in the sand and hope this problem goes away but I've never been a fan of the strategy of HOPE, have you?

Without this site we would all be stuffed by west brom and then any lender who felt like dipping into our pockets at will !!!

Hi guys,

As a mortgage broker and a landlord I think we should all be doing our up-most to fight this, this will effect everyone, for heavens sake let not sit on the fence let's try and get this sorted.

I have emailed my MP (Mark Lancaster MP Cons' Milton Keynes South) sending him Property118's article and he has been in contact with West Brom regarding this. West Brom have subsequently come back to me advising that they cannot talk to him as they do not have authority. Needless to say we have not left it there but await their reply!

I am a mortgage broker and so am involved in both sides, i.e. as a Broker and also as a Landlord with an affected loan.

Come guys let's all get together!

Yet, WB itself is more than happy to seek to breach DP legislation when it suits its own purposes, such as by obtaining personal and sensitive information at will for commercial purposes as it did about myself when it went to Experian on 3 November 2013 to validate its decision to impose the 1.9%.

It also asked me to provide full portfolio details in a recent letter, including for a property I don't even own, but which is owned solely by another member of my family.
