West Bromwich Building Society Tracker Margins Legal Action

Are you affected by the West Brom Tracker Rate Hike?

If your mortgage account number begins with the number 8 you are highly likely to be one of the unlucky 41% of the mortgage customers of the West Bromwich building Society with a West Bromwich Mortgage Company account affected by the 1.9% increase in your tracker margin rate. However, if you arranged your mortgage directly with West Bromwich Building Society (i.e. not via a broker) or before 2006 the chances are that your account number will begin with the number 9 and you are not affected – YET!!! West Brom will give no assurances that mortgages with account numbers beginning with the number 9 will not be affected at some point in the future.

Tracker Rate Class Actions Updates

The reasons we started this campaign are very simple:-

1) We believe the actions of West Brom are immoral

2) We believe the actions of West Brom are unlawful, i.e. they have no legal grounds to increase their tracker rate margins

3) We have no wish to subsidise other areas of the West Bromwich Building Society business model

4) We are fearful of other lenders following suit if West Brom are allowed to get away with this

Mark Smith (Barrister-At-Law) said …

“Representative actions, where one person starts a case representing many others, who all want the answer to a legal question from a court such as ‘is this contract enforceable against me?’ but are not seeking damages. All those who sign up to the action will get the benefit of the win, but they do not have to start their own cases, as they are ‘represented’ by the lead claimant.

The only people who will definitely benefit from success in the case are those who have signed up. There will be no free rides. Any others will have to fight their own corners individually, either alone or with legal help (which will inevitably cost significantly more than the group case).”

We'll said mike. Only a fool to not get in now. With continued effort from everyone up to Christmas there is no reason we can't hit that £100000 before we all break for the holidays. Then come back fresh and ready to go to court. I can see this hitting £120000 easily. Especially if the entry price increases on councels positive opinion.

Wow. That is fantastic. Well done to all those over the last 3-4 weeks for the extra effort put in to get the fund this far. A great effort when things seemed to be dropping a little flat. And a thank you to all those fence sitters for doing the right thing and contributing not only their hard earned money but I've also noticed some additional posting from them too.

Keep up the good work til Christmas everyone before a well deserved rest. Although why don't we all take a break this weekend only posting to welcome and assist any new members. ?

Looking very much toward councel opinion now and the boost that will give the fund financially and our spirits.

i guess my earlier and first post got lost in the excitement of getting barristers input and rightly so.... - so i repost in the hope that someone can clarify my own position - thank you

I have been following the thread for a while but only recently registered on 118. I only have one mortgage with West Bromwich Mortgage Company Limited (transferred to them in 2004 and with an '8' at the beginning of my account number) which I originally bought from another company. Long before the latest bru-ha-ha I had been overpaying my IO mortgage by a substantial amount per month.

Could this be the reason that I have not had any letters from WBMCL. I am confused in so far as, i am not clear if the ripping up of contract law by WBBS only applies to WBBS customers – or does it apply to WBMCL also ?

I utterly agree that if these guys get away with it we will all suffer (whoever our lenders are) and I am more than happy to contribute financially for the greater good.

But, will I be part of the Class Action or not ?

It may well be that West Brom believe you are not a portfolio landlord. If your payments go up then you will know that you are affected but haven't received notification for some reason. If not affected I'd keep your head down for now if I were you 🙂

thank you Mark - that is most reassuring - hence now you understand my soubriquet !!! but i do want to make a financial donation to the fighting fund anyways - all landlords will be affected in 2014 if WB get their way with this nonsense. Have you had many "non-WBBS-mortgage-product holders" making contributions ?

The energy and enthusiasm of those already signed up is very encouraging....and at times impressive BUT.....only 286 loans out of 6700 = 4.3% and is hardly wow factor.

Hopefully things will get better.

I can imagine many are not looking forward to putting their hands in their pockets to make up any shortfall in funding.

Only to the Marketing Fund as Justin is only holding funds on his client account for affected borrowers.

Thanks for your offer to pitch in even though you are not currently affected, it is much appreciated. We have quite a few others, the most notable being Annette Stone and Ed Atkinson who both made a very generous donation and have been very active supporters of the campaign.

Considering how few of the affected borrowers are likely to be members of Property118 I suspect that 4.3% of the overall total is not bad going at all.
