West Bromwich Building Society Tracker Margins Legal Action

Are you affected by the West Brom Tracker Rate Hike?

If your mortgage account number begins with the number 8 you are highly likely to be one of the unlucky 41% of the mortgage customers of the West Bromwich building Society with a West Bromwich Mortgage Company account affected by the 1.9% increase in your tracker margin rate. However, if you arranged your mortgage directly with West Bromwich Building Society (i.e. not via a broker) or before 2006 the chances are that your account number will begin with the number 9 and you are not affected – YET!!! West Brom will give no assurances that mortgages with account numbers beginning with the number 9 will not be affected at some point in the future.

The reasons we started this campaign are very simple:-

1) We believe the actions of West Brom are immoral

2) We believe the actions of West Brom are unlawful, i.e. they have no legal grounds to increase their tracker rate margins

3) We have no wish to subsidise other areas of the West Bromwich Building Society business model

4) We are fearful of other lenders following suit if West Brom are allowed to get away with this

Mark Smith (Barrister-At-Law) said …

“Representative actions, where one person starts a case representing many others, who all want the answer to a legal question from a court such as ‘is this contract enforceable against me?’ but are not seeking damages. All those who sign up to the action will get the benefit of the win, but they do not have to start their own cases, as they are ‘represented’ by the lead claimant.

Yeah, I know what you mean about submitting so-called 'e-mails' via websites. They aren't really e-mails at all, are they? ....and yes, I too copy any comments I make before submitting, as they do indeed then disappear without a trace to the sender. Convenient for the recipient, eh? The cynic in me says that they deliberately don't provide proper e-mail addresses, as then tracing etc. is so much easier, and records kept on the sender's account. The same goes for certain programmes on the BBC website. Woman's Hour being one of them! (and yes, I have written a couple of heated e-mails in light of their blatant sexism, the very thing those feminists claim is happening to them!).
For a screen shot on a PC, press Alt+'Prt Sc'; and on a Mac, cmd+shift+3. However, merely taking a screen shot, sadly, doesn't mean you actually posted it, technically speaking. It's in a pre-send state. It's therefore not proof of you having actually 'sent' anything 🙁 Of course, once you HAVE sent it it's too late to 'capture' anyway, as it's disappeared from view.
Sorry to pour water on you like this, but equally I hope you're pleased to know how to print what's on your screen! 🙂

Going back to an older topic - I have just received my Subject Access Request documents and the file is massive! Not only will this information have taken someone days / weeks to colate but it has also been sent recorded delivery. The cost in both man hours and financial to WB in preparing such a document must be huge. Furthermore the screen shots and CD's make for some very interesting listening.
I would strongly encourage anyone who has not yet done so to send in their SAR (and £10) after all in order to fight this case we should at least have all the evidence.

I have referred the solicitor with 11 mortgages directly to Justin. His payment increase is a whopping £3k pcm. I had hoped he would post on here but he's holding back for the time being. It seems he is in the early stages of his thought processes and may just decide to shelve his idea and join us. His thoughts before speaking to me were to seek an injunction against the increase (privately funded) but I've shared Justin's reservations on that with him. If he does it we will at least get to see West Brom's defence so it can do not harm, other than to this chaps wallet. Either way he is considering joining our Class Action to hedge his bets. We have agreed to chat again when he's had an opportunity to talk to Justin.

Who owns the WB Mortgage Company, and to whom is its Board responsible?

Dear AL,

I have not looked into this point in detail. I was pointing out that WBML is a separate legal entity from the WBBS, and setting out the reason why I suspect that is. The WBBS promotional material does not distinguish between the two entities, the mortgages are said to be 'from the West Brom'.
As and when the case is launched this point will be clarified and the WB will have to explain themselves.

Can anyone comment on the following scenario......

Lets assume the Class Action is successfull, everyone affected gets paid what they are due, West Brom gets slapped for their attempt to increase their income etc etc.

West Brom are then left in, I assume, a slightly worse situaton than they are today ie loosing many £millions pa.

Is there a likelyhood they will go under / need to be rescued ? What hapens to our mortgages then.......do they get sold / transferred to a new lender ?
