West Bromwich Building Society Tracker Margins Legal Action

Are you affected by the West Brom Tracker Rate Hike?

If your mortgage account number begins with the number 8 you are highly likely to be one of the unlucky 41% of the mortgage customers of the West Bromwich building Society with a West Bromwich Mortgage Company account affected by the 1.9% increase in your tracker margin rate. However, if you arranged your mortgage directly with West Bromwich Building Society (i.e. not via a broker) or before 2006 the chances are that your account number will begin with the number 9 and you are not affected – YET!!! West Brom will give no assurances that mortgages with account numbers beginning with the number 9 will not be affected at some point in the future.

The reasons we started this campaign are very simple:-

1) We believe the actions of West Brom are immoral

2) We believe the actions of West Brom are unlawful, i.e. they have no legal grounds to increase their tracker rate margins

3) We have no wish to subsidise other areas of the West Bromwich Building Society business model

4) We are fearful of other lenders following suit if West Brom are allowed to get away with this

Mark Smith (Barrister-At-Law) said …

“Representative actions, where one person starts a case representing many others, who all want the answer to a legal question from a court such as ‘is this contract enforceable against me?’ but are not seeking damages. All those who sign up to the action will get the benefit of the win, but they do not have to start their own cases, as they are ‘represented’ by the lead claimant.

The only people who will definitely benefit from success in the case are those who have signed up. There will be no free rides. Any others will have to fight their own corners individually, either alone or with legal help (which will inevitably cost significantly more than the group case).”

Do not underestimate how difficult it can be to find things on the internet at times.

This may seem an absurd statement so I will illustrate with an example.

I have spent my career (40+ years man and boy) in electronics & computing - mostly designing and using computers and computer based systems,

An earlier adopter for the most part, I like to think that I know my way around the internet and the various tools for getting the best out of it - especially the search engines.

However, on more than one occasion I have been frustrated by spending ages trying to track down information on a subject which I just can't understand is not filling my screen with relevant search results (and trust me, I do not give up easily) only to have a colleague (who's mind works slightly differently) come along and enter a simple search term that I had not thought of and illicit a myriad of relevant results at a click.

This "blindness" can be particularly difficult to overcome in situations where, as many of us do, one works alone with nobody else to bounce off.

My point is that, trivially** easy though many will think it is to find this site when one sets out to search for information on the WB rate hike, it can be surprising just how difficult some people may be finding it.

[** Everything seems easy once one has accomplished it!]

And of course, despite assertions to the contrary on this thread, many people still really don't "get" computers and will use them only most reluctantly (and ineffectively) or not at all - especially older people, towards which I suspect that the landlord demographic is somewhat skewed.

Thus we must continue to try and reach people via as many different avenues as possible.

I haven't heard of the base rate + 1% figure before, but I do know that the 'official interest rate' is currently 8% as this is the figure that I have been advised I can expect to receive in respect of some other litigation that I am involved in should we win the case.

I am not an expert, but I did query this figure quite robustly and was assured that it is correct.

Businesses recovering debts against other business are usually entitled to claim the higher rates of interest available under the Late Payment of Commercial Debts (Interest) Act 1998. Alternatively, they may make contractual provision for interest rates.

Claims for damages are not covered by the 1998 Act. In damages claims, there tends to be a variation between the practice of the High Court (especially the Commercial court and the Admiralty court) which often awards interest at base +1%) and the county courts, which routinely apply an 8% rate.

These awards of interest are of course subject to the discretion of the court and the court can either increase or reduce the interest awarded.

West Bromwich Commercial Limited is a subsidiary of the West Bromwich Building Society and provides mortgages to fund the acquisition of commercial investment properties.

I think it would be well worth getting in touch with Prideview Properties as they have many borrowers in a similar situation to us and are also considering launching a class action lawsuit. It's another potential source of funding and may well be a mine of useful information re: our own class action lawsuit against the West Bromwich Building Society.

I can't help but wonder if the West Brom spend a lot of money with the Express and Star newspaper. Many of our comments were removed from the PR article they ran about the new West Brom office and now they are running this promotional piece >>>

David , that is a fantastic letter . I hope it hits the mark. I fear , like many others, although I doubt as well written , it will get a standard reply.

Have you thought about adding reference to the information The Man From Nowhere has just posted 11.59 today.

Also I spotted a couple of typos you put ten tears not years

and further down overt not over . Not trying to be picky at all but it is so good it would be a shame for simply typos to be in there
