West Bromwich Building Society Tracker Margins Legal Action

Are you affected by the West Brom Tracker Rate Hike?

If your mortgage account number begins with the number 8 you are highly likely to be one of the unlucky 41% of the mortgage customers of the West Bromwich building Society with a West Bromwich Mortgage Company account affected by the 1.9% increase in your tracker margin rate. However, if you arranged your mortgage directly with West Bromwich Building Society (i.e. not via a broker) or before 2006 the chances are that your account number will begin with the number 9 and you are not affected – YET!!! West Brom will give no assurances that mortgages with account numbers beginning with the number 9 will not be affected at some point in the future.

Tracker Rate Class Actions Updates

The reasons we started this campaign are very simple:-

1) We believe the actions of West Brom are immoral

2) We believe the actions of West Brom are unlawful, i.e. they have no legal grounds to increase their tracker rate margins

3) We have no wish to subsidise other areas of the West Bromwich Building Society business model

4) We are fearful of other lenders following suit if West Brom are allowed to get away with this

Mark Smith (Barrister-At-Law) said …

“Representative actions, where one person starts a case representing many others, who all want the answer to a legal question from a court such as ‘is this contract enforceable against me?’ but are not seeking damages. All those who sign up to the action will get the benefit of the win, but they do not have to start their own cases, as they are ‘represented’ by the lead claimant.

The only people who will definitely benefit from success in the case are those who have signed up. There will be no free rides. Any others will have to fight their own corners individually, either alone or with legal help (which will inevitably cost significantly more than the group case).”

Thank you for the reply from the treasury. However in the light of the RBS scandal which the treasury is prepared to comment on,

perhaps the treasury could reply to the following?

A quote from the Telegraph
Andrew Tyrie, chairman of the Treasury Committee, said the reports revealed “a fundamental cultural problem with RBS’s lending to

and treatment of SMEs”.

It is interesting that the government is now prepared to make comments and look into the fact that the RBS was accused of trying to put

small businesses out of business, in order to buy/sell the properties of the SBE's inorder to make more profit.

However when the treasury was informed of the West Bromwich Mortgage Company Ltd (a wholely owend subsiduary of the West

Bromwich Building Society) attempting to do the same by raising the interest rates on a Bank of England Base rate for ONLY businesses

(their terms not mine) and small businesses (more than 3 properties) in order to get round consumer protection. This is the reply which is

exactly the same as the one to one of the contributors to Property118.com a forum set up specifically to air and help the fight against the

WBBS. As you can see there is no sympathy at all, as this is purely a business matter (As was the RBS's until the government was

embarassed into taking, action even if only to make the above statement.)

Could you please help or investigate or whatever you can do.

I know this is not YET exactly the same situation but its getting there very fast and WILL put some profitable SME's out of business just so

the WBBS can profit, much like the RBS I'd argue. (Just read in the forum for examples of this, if you do not have the time or resources I

will ask for the permission of the relevant SME's to publish their details to you if you wish)

"Property 118 forum is organising a class legal action against the West Bromwich Mortgage Company Ltd which mendaciously claims it has the right to increase the premium on tracker BTL mortgages by 2%.

It is only applying this illegal levy on customers who used intermediary brokers.

Those who applied direct to the company, or through its own broking company, are immune.

Other lenders have told the FCA that they want do breach their contracts in a similar fashion, but are waiting for the outcome of WBMC's ploy.

So it is in the interest of anyone with a tracker BTL mortgage to join Property118's campaign, because they may be the next victims.

It is particularly important that WBMC customers who are affected by this increase be given the opportunity of joining the class action.

So, would all brokers please pass this message on to all their clients who have tracker BTL mortgages, and give them this website address:

I have been trying to get my head around why some are not signing up, I was thinking that they feel that the FCA will eventually step in to stop these increases.

I spoke to a chap the other day who didn't realise he had to be a Property118 member to post a comment. He thought being a paid up member of the Class Action was the same thing so I had to point him to the member section. He's since joined and started commenting. Maybe that's Kevin's problem?

MESSAGE TO MORTGAGE ADVISERS AND SOLICITORS

In the unlikely event of us losing our case against West Brom then it will be clear that you were negligent in not pointing out the Mortgage Conditions which West Brom are allowed to use against us. Therefore, to save claims on your own PI policies it is in your interests to make sure we can beat West Brom in Court. To help us achieve this we need to engage with more affected borrowers. YOU my friends are in a position to make the necessary introductions. The choice is yours.

You might be right but it's a very risky strategy. I suspect the FCA will also play the waiting game to see if this all blows over or the outcome of the Court case. The FCA have quite a track record for closing the door after the horse has bolted as we all know.

No fence sitters on this forum can possibly still be thinking that the FCA will rescue them by now Ian. To continue our speculation as to their motives for keeping their heads down would seem a fruitless exercise. You can lead a horse to water but you can't make it drink.

If rhough you are thinking of other WB BTL borrowers who don't know about us, who knows what is coursing through their minds? Sadly these days apathetic acceptance of "our lot" prevails in so many areas. Have a bleat and a bellyache down the pub then do nothing.

Having said that my firm belief is that there are indeed still many many fellow WB BTL borrowers who are completely unaware of us and our fight. Our job is to find them because some will join the campaign for sure. Mind you quite a few having found us won't so we' ll have more fence sitters on the forum!

C'est la vie. We've got lawyers, accountants, mortgage experts, a doctor and other experts among our midst. Is there a psychologist out there who can throw some light on these baffling quandaries re the human mind?
