West Bromwich Building Society Tracker Margins Legal Action

Are you affected by the West Brom Tracker Rate Hike?

If your mortgage account number begins with the number 8 you are highly likely to be one of the unlucky 41% of the mortgage customers of the West Bromwich building Society with a West Bromwich Mortgage Company account affected by the 1.9% increase in your tracker margin rate. However, if you arranged your mortgage directly with West Bromwich Building Society (i.e. not via a broker) or before 2006 the chances are that your account number will begin with the number 9 and you are not affected – YET!!! West Brom will give no assurances that mortgages with account numbers beginning with the number 9 will not be affected at some point in the future.

Tracker Rate Class Actions Updates

The reasons we started this campaign are very simple:-

1) We believe the actions of West Brom are immoral

2) We believe the actions of West Brom are unlawful, i.e. they have no legal grounds to increase their tracker rate margins

3) We have no wish to subsidise other areas of the West Bromwich Building Society business model

4) We are fearful of other lenders following suit if West Brom are allowed to get away with this

Mark Smith (Barrister-At-Law) said …

“Representative actions, where one person starts a case representing many others, who all want the answer to a legal question from a court such as ‘is this contract enforceable against me?’ but are not seeking damages. All those who sign up to the action will get the benefit of the win, but they do not have to start their own cases, as they are ‘represented’ by the lead claimant.

The only people who will definitely benefit from success in the case are those who have signed up. There will be no free rides. Any others will have to fight their own corners individually, either alone or with legal help (which will inevitably cost significantly more than the group case).”

The simple answer is let's worry about that if/when we need to.

I doubt they would do it part way through the first case buy who knows? Once the case is prepared I doubt we could add new claims.

From here the process is:-

QC's opinion
ATE insurance quote
Fund raising closed when we can afford to progress
Case prepared and submitted
Arguing out of Court
Arguing in Court
Win/Lose/Appeal

....... and loads more PR work for us all in the meantime of course.

Although an application to add add new claims under CPR Part 19 (addition or substitution of parties) can be made, the court's case management powers in Group Litigation Orders include directions specifying a date after which no claim may be added to the group register unless the court gives permission. It therefore certainly makes sense to have all the claims registered at the outset.

That's a long-winded way of saying to anyone still sitting on the fence still debating whether to stump up £240 per affected mortgage to join the class action and climb aboard now before the ship sails. (No smart alec comments about the ship being the S.S. Titanic please!)

Hi all, Just got papers from WB the papers are headed Mortgage Deed are these what i send Justin with the fee.
Description of this mortgage BLT Tracker - Base Rate + 0.25% for 2 years-a veriable rate which is the same as the BoE base rate currently 4.5% with a premiumof 0.25% ontil end of **/**/****giveing a current rate payable of 4.74% Any change in the BoE Base Rate will be appliedto your account on the first day of the month.
Seperate box
After **/**/**** Part 1 of your loan reverts to a variable fate which is the same as the BoE Base Rate currently 4.5% with a primium of 0.99%, until end of term...giving a current rate payable of 5.49% BoE BR will be appllied to your account on the first day of the month.
This is what i singed for so i will be will fight this with all you help. my monthly mortgage will go up more than the £240.00
So everyone not yet joined the class action please think of what you will be paying extra each month and who knows what and when the next raise will from WB
