West Bromwich Building Society Tracker Margins Legal Action

Are you affected by the West Brom Tracker Rate Hike?

If your mortgage account number begins with the number 8 you are highly likely to be one of the unlucky 41% of the mortgage customers of the West Bromwich building Society with a West Bromwich Mortgage Company account affected by the 1.9% increase in your tracker margin rate. However, if you arranged your mortgage directly with West Bromwich Building Society (i.e. not via a broker) or before 2006 the chances are that your account number will begin with the number 9 and you are not affected – YET!!! West Brom will give no assurances that mortgages with account numbers beginning with the number 9 will not be affected at some point in the future.

OUR INTENDED CLASS ACTION LITIGATION OVERVIEW

Tracker Rate Class Actions Updates

The reasons we started this campaign are very simple:-

1) We believe the actions of West Brom are immoral

2) We believe the actions of West Brom are unlawful, i.e. they have no legal grounds to increase their tracker rate margins

3) We have no wish to subsidise other areas of the West Bromwich Building Society business model

4) We are fearful of other lenders following suit if West Brom are allowed to get away with this

Mark Smith (Barrister-At-Law) said …

“Representative actions, where one person starts a case representing many others, who all want the answer to a legal question from a court such as ‘is this contract enforceable against me?’ but are not seeking damages. All those who sign up to the action will get the benefit of the win, but they do not have to start their own cases, as they are ‘represented’ by the lead claimant.

The only people who will definitely benefit from success in the case are those who have signed up. There will be no free rides. Any others will have to fight their own corners individually, either alone or with legal help (which will inevitably cost significantly more than the group case).”

Very well said Alison. I would just like to say that I have been very ill for a while now with a bad flare up of a chronic illness. This forum until the last few hours has been so positive and full of camaraderie and has been really helping to give a bit of extra strength and positivity. Please, please don't fall out over daft little comments anyone. Just draw a line under all this and let's move on and keep up the strength and good work we have all put in so far! 🙂

I cannot find your last post in connection to an Open Memo you sent to Nicole @ The Telegraph about West Brom only targeting 41% of Lifetime Tracker mortgages and TCF and all that...

I have left repeating messages and sent emails for Kevin Duffy from Mortgage Force to see if they are interested in supporting this forum and helping their affected clients.

To recap, Mortgage Force are a Mortgage Brokers and were a wholly owned subsidiary of West Brom from 2005 - 2011 when the West Brom sold back the management team and kept a minority stake in the company, which they confirm they still have.

As they had hundreds of advisors selling Mortgages in the period and The West Brom were distributing their products through, as not One Reader on this forum has stated they obtained their mortgage through Mortgage Force, Mortgage Force do not want to return phone calls/emails and moreover, in light of the 'razer sharp' targeting by The West Brom of the Rate Hike, can you ask Nicole from The Telegraph to contact Mortgage Force for comment ?

Surely she would have a further angle to write about if The West Brom have not targeted Lifetime Tracker customers that were introduced by their own mortgage brokers !!!!

Just to clarify, is it £240 per AFFECTED West Brom's Buy-To-Let tracker mortgage or is it also £240 for West Brom's Buy-To-Let tracker mortgages that are not affected (AS YET ANYWAY) e.g. those mortgages that have account numbers beginning with 9? Or is it £240 per mortgage that you have with the West Brom regardless of whether it is a tracker rate, SVR, fixed rate, offset etc...?

The reason I ask is that I also have one tracker Buy-To-Let mortgage with the West Brom with a mortgage account number beginning with 9 that has not been affected and another West Brom Buy-To-Let product that is on the Standard Variable Rate. The other 6 West Brom Buy-To-Let mortgages I have already paid £240 each for.

Any clarification regarding the above would be greatly appreciated. Thank you.

Don’t let him get to you, Dean, he’s not worth it. When he first posted, his attitude seemed condescending and demanding, out of tune with the rest of the contributors.

He asked if he should register all of his BTL mortgages. Denise Doms replied immediately, trying to help him.

Then he trumped her with his master-stroke, answering his own question – he intends to sell some of the properties.

How could we have failed to realise that he was selling some, just because he didn’t say so in the first place?

Two hours later you replied to his first request, without having reached his answer about his sales. How RIDICULOUS!

Dean, I have read every comment on this site, and it seems to me that apart from Mark Alexander, you have done more work on this campaign than anybody else. You have my unbounded admiration. Don’t be undermined by this trouble-maker. It may just be his nature, or he may indeed work for WB, but just ignore him.
