West Bromwich Building Society Tracker Margins Legal Action

Are you affected by the West Brom Tracker Rate Hike?

If your mortgage account number begins with the number 8 you are highly likely to be one of the unlucky 41% of the mortgage customers of the West Bromwich building Society with a West Bromwich Mortgage Company account affected by the 1.9% increase in your tracker margin rate. However, if you arranged your mortgage directly with West Bromwich Building Society (i.e. not via a broker) or before 2006 the chances are that your account number will begin with the number 9 and you are not affected – YET!!! West Brom will give no assurances that mortgages with account numbers beginning with the number 9 will not be affected at some point in the future.

Tracker Rate Class Actions Updates

The reasons we started this campaign are very simple:-

1) We believe the actions of West Brom are immoral

2) We believe the actions of West Brom are unlawful, i.e. they have no legal grounds to increase their tracker rate margins

3) We have no wish to subsidise other areas of the West Bromwich Building Society business model

4) We are fearful of other lenders following suit if West Brom are allowed to get away with this

Mark Smith (Barrister-At-Law) said …

“Representative actions, where one person starts a case representing many others, who all want the answer to a legal question from a court such as ‘is this contract enforceable against me?’ but are not seeking damages. All those who sign up to the action will get the benefit of the win, but they do not have to start their own cases, as they are ‘represented’ by the lead claimant.

The only people who will definitely benefit from success in the case are those who have signed up. There will be no free rides. Any others will have to fight their own corners individually, either alone or with legal help (which will inevitably cost significantly more than the group case).”

Yes I thought that would be the case. However, nothing to stop people setting their owm payment plan if they have more than one mortgage by staging sending in the documents and cheque. Bit of a risk if window closes or fee goes up, but better than not being in at all.

Does Justin have the option of taking payments by credit card from people ?

I explored all the avenues and, after taking legal advice, decided to join the group as I believe we will have a louder voice. Rolling over was not an option. I have been in business for many years and a contract is a contract to be upheld.

Yes Richard drip payments could cause all sorts of problems , someone could end up in Court.

The credit card idea maybe a possibility. Id be surprised if The Law Department didn't have that facility.

I've followed this forum from very early on and have read every single comment so far. I too sense that the momentum is building again and have always believed that two big milestones for us will be when the extra payments actually kick in and the Counsel's opinion comes through. For those two reasons I believe we should be just a little more patient. I’m sure that there are many who’ll decide to do research and join only after they see an unexpectedly large DD on their bank statement. It’s only fair to wait for them as long as we can.

On the other hand, I know that many of us here can't wait for the opportunity to face WBBS in court and once again Mark summed it up beautifully. Once we get going things will most likely move quickly. There is a real risk for the late comers that they will be left behind. I can’t therefore see how £240 can be seen to be too much to make sure you’re fully on board, especially if you consider the cost of being left behind.

Hi Alan. I would suggest you send an email to Ana at the Law Department via ana@lawdepartment.co.uk to see if your documentation has been received. Ana is handling a lot of the admin for Justin and should be able to tell you if they have got your papers and payment.

Hi Matthew

You are still on a tracker mortgage as WB's letter rejecting our protests made clear. The letters about the 2% and 1.9% increases both describe them as trackers.

The novelty is that WB are pretending that the fixed premium over Bank of England Base Rate is variable. This is an exciting new financial "product" that was devised earlier this year by Alice, in Wonderland.

In one of her books a character says "When I use a word it means exactly what I choose it to mean, no more and no less". This has been incorporated in WB's training manual, I believe.
