West Bromwich Building Society Tracker Margins Legal Action

Are you affected by the West Brom Tracker Rate Hike?

If your mortgage account number begins with the number 8 you are highly likely to be one of the unlucky 41% of the mortgage customers of the West Bromwich building Society with a West Bromwich Mortgage Company account affected by the 1.9% increase in your tracker margin rate. However, if you arranged your mortgage directly with West Bromwich Building Society (i.e. not via a broker) or before 2006 the chances are that your account number will begin with the number 9 and you are not affected – YET!!! West Brom will give no assurances that mortgages with account numbers beginning with the number 9 will not be affected at some point in the future.

The reasons we started this campaign are very simple:-

1) We believe the actions of West Brom are immoral

2) We believe the actions of West Brom are unlawful, i.e. they have no legal grounds to increase their tracker rate margins

3) We have no wish to subsidise other areas of the West Bromwich Building Society business model

4) We are fearful of other lenders following suit if West Brom are allowed to get away with this

Mark Smith (Barrister-At-Law) said …

“Representative actions, where one person starts a case representing many others, who all want the answer to a legal question from a court such as ‘is this contract enforceable against me?’ but are not seeking damages. All those who sign up to the action will get the benefit of the win, but they do not have to start their own cases, as they are ‘represented’ by the lead claimant.

The only people who will definitely benefit from success in the case are those who have signed up. There will be no free rides. Any others will have to fight their own corners individually, either alone or with legal help (which will inevitably cost significantly more than the group case).”

Hi Dean

I think raising the money is a foregone conclusion don't you? Most affected borrowers will chip in to fund the balance required. It's only fair to keep the door open whilst we can but once it's closed that's it, if you're in you're in and if you're not its too late. Time is running out and when it does the window of opportunity to get involved will close very quickly. Now is the time to get in and that's why I think we e seen so many on the sidelines having made the leap of faith in the last few days and feeling much better for having done so

I think we are really getting there and I know you know more than me, plus there are the other opportunities in the back ground that may or may not come off. But I think people sat on the side lines need it spelling out, once that window of opportunity as closed that could be it for them. It might not be but they will have no recourse to come back on here pleading for a second chance.

We have offered them a chance to make public or private their reasons for not joining . No one is going to hold it against anyone who is unsure if they just put forward why they are sceptical. All we want to do is be given the chance to put our good and genuine reasons to them.

However, they do need to realise we cant hang around for ever for them. We have momentum, we have a large proportion of funds to move forward, but from next month onwards we are all worse off, so action is what is needed.

Yes I have noticed the readers have increased . That has to be a good thing. Last week was a good week for funds too and I hope this week will be.

Is there anyway you can do one email to all those registered trying to give them a gee up. Some may have registered and gone away thinking we had no chance of getting to the required target. Their attitude may differ now .

Great stuff emerging daily as the forum grows plus new borrowers coming off the fence to join the action. Terrific. I feel good, and proud.

Re getting the remaining ongoing fence sitters on board tell me if I'm mad,but how about this concerning those who genuinely will struggle to find £240 per mortgage where they have more than one with WB? There have been posts from those in this position and the thread in reply has been find all the money somehow and come on board with all your mortgages"or else you might lose out".

If someone is really strapped to join then encourage them to do so paying for as many mortgages as they can afford. Better one or two than none plus it raises more funds for the action.

Then they ride the wave with us to success in court as named in the action and their paid for mortgages are sorted. Then for those mortgages they could not afford to come on board with they proceed against WB via Small Claims Court for reimbursement. Our win in court will arm them OK for a Small Claims action as District Judges DO take note of such case law. District Judges also seem to err on side of consumers normally. There would be so much evidence that a plaintiff could produce that I can't see WB defending successfully. It is also quite cheap to do.

We need to remember that our rules while quite fair can disadvantage some folk I am lucky that I only have one WB BTL mortgage, although unlucky that it a bigun. I only have to pay £240 therefore. Were I to have three smaller mortgages totaling the same loan amount I would need to pay £720 which I would have struggled to find. So using this example I would surely have been better off in the long run coming on board with at least one of them than staying away altogether?

That's not a bad idea. To some extent that's what I and my property partners did. Risked a smaller amount then went all in.

We could also look at registering all mortgages and organising a payment plan over say 4 months maximum. Bit more admin so maybe make it £252 per mortgage on that basis ( £210 plus VAT)

Forgive me if this has already been answered, but one thing I forgot to ask is how long does Justin take to acknowledge receipt of documentation as I notice that he has not yet cashed my cheque, although this was sent over a week ago.

Welcome aboard Alan,
I take it you decided there are no easier or cheaper alternatives to joining? And rolling over for WB was not an option?

It seems like the tide is turning and we are getting ready to cast off. There's room for 6700 but the rest will have to get a move on or the ship will sail without them.

Fair comment Mark. Dean did suggest it would be an admin headache. I don't want to urge people into debt but could they pay via credit card?

If one of us took on running payment on the drip participation is that a possibility? Provided that is whoever was trusted to do so does not startt answering e mails form a beach in the Bahamas!
