West Bromwich Building Society Tracker Margins Legal Action

Are you affected by the West Brom Tracker Rate Hike?

If your mortgage account number begins with the number 8 you are highly likely to be one of the unlucky 41% of the mortgage customers of the West Bromwich building Society with a West Bromwich Mortgage Company account affected by the 1.9% increase in your tracker margin rate. However, if you arranged your mortgage directly with West Bromwich Building Society (i.e. not via a broker) or before 2006 the chances are that your account number will begin with the number 9 and you are not affected – YET!!! West Brom will give no assurances that mortgages with account numbers beginning with the number 9 will not be affected at some point in the future.

Tracker Rate Class Actions Updates

The reasons we started this campaign are very simple:-

1) We believe the actions of West Brom are immoral

2) We believe the actions of West Brom are unlawful, i.e. they have no legal grounds to increase their tracker rate margins

3) We have no wish to subsidise other areas of the West Bromwich Building Society business model

4) We are fearful of other lenders following suit if West Brom are allowed to get away with this

Mark Smith (Barrister-At-Law) said …

“Representative actions, where one person starts a case representing many others, who all want the answer to a legal question from a court such as ‘is this contract enforceable against me?’ but are not seeking damages. All those who sign up to the action will get the benefit of the win, but they do not have to start their own cases, as they are ‘represented’ by the lead claimant.

The only people who will definitely benefit from success in the case are those who have signed up. There will be no free rides. Any others will have to fight their own corners individually, either alone or with legal help (which will inevitably cost significantly more than the group case).”

I agree with you, to start with I was very sceptical after all I had already been shafted once. But following the discussions and doing some homework I am now confident to invest £720 into the cause.

What have I got to lose, £720 is pretty much the extra monthly cost I will have to pay for the rest of the term so what is one extra payment....

Yes I can see that. But I think when we are paying into a solicitors client account we can be pretty certain things are above board. When it starts getting transferred into a Nigerian bank account we might get I little bit more worried.

Ian. I'm sure that is probably the main reason. Other main reason will be people hoping it will get sorted without having to contribute.

These are the ones we need to convert. Everyone now joining are telling us how much better they feel. I have only just persuaded my property partners to pay for each mortgage. I felt so much better once they agreed. I would have been devastated if an agreement of some sort had been arranged and only one of the 7 I have we're included.

I think there will be others out there like us who only paid for one thinking that they would get the details for one and use it for all of them. If anyone as done that I would suggest you have another think Same as we did. Don't feel you can't pay for them all once you have committed to one. No one will judge in fact they would probably never know.

I agree and to a certain extent i am embarrassed to think I suspected the motives of this site. Having looked into things I am so sure everything is as it says it is, I have sent in my contribution for 3 properties.

The organisers and Mark Alexander in particular are doing such an incredible job that it would be an insult to expect them to have to justify everything to the cynics out there.

But the reality is that there will be plenty of people out there who understandably just a need a bit of reassurance before they commit.... For my part all i can say is i am the ultimate cynic but i am more than happy to contribute.

Don't be embarrassed. The whole reason behind the class action is as a result of us all having our leg lifted. Each and everyone of us have been ripped off. There is a hell of a lot of it out there. I must get ten emails a day asking for my bank details.

However who wouldn't be suspicious. We have all been had by a British banking organisation and not one government body or organisation that we all thought were there to look after us have not shown the slightest interest. They can't even be bothered to answer the questions we have asked. They have made an assumption we are complaining about interest rate rises and not a contract dispute.

Ian & Dean, I just can't buy that folk are still holding back for fear of a scam? With the posts from Mark and Justin regularly appearing it really can't be more straight up. If misgivings still persist a private approach to either of them or indeed to other notable worthies who post would surely dispel lingering suspicions? Quote from Rudyard Kipling. "In this life I have feared many things, most of which never happened". So true.
